Արարատի համայնքապետարաններից մեկի պաշտոնատար անձինք քաղաքացիներից կաշառք են ստացել

ՀՀ հակակոռուպցիոն կոմիտեում քննված քրեական վարույթով իրականացված նախաքննությամբ պարզվել է, որ ՀՀ Արարատի մարզի համայնքապետարաններից մեկի ղեկավարի տեղակալ Ա. Հ.-ն նույն համայնքապետարանի համապատասխան ստորաբաժանման պետ Հ. Դ.-ի հետ՝ խմբի կազմում, օգտագործելով ծառայողական լիազորությունները, մի շարք անձանց օժանդակությամբ, ինչպես նաև անձամբ, պահանջել և ստացել են տարբեր չափերի կաշառք: 

Մասնավորապես՝ հիշյալ պաշտոնատար անձինք 2024 թվականի օգոստոսին իրենց մարզի բնակավայրերից մեկի վարչական ղեկավարի միջոցով համայնքային սեփականություն հանդիսացող հողամասը նույն բնակավայրի բնակչին աճուրդ-վաճառքով, առանց մասերի բաժանելու, օտարելու  համար ստացել են 150.000 ՀՀ դրամ կաշառք:

Պարզվել է նաև, որ Ա. Հ. -ն և Հ. Դ.-ն 2024 թ. մայիսից հոկտեմբերն ընկած ժամանակահատվածում նույն համայնքապետարանի աճուրդային հանձնաժողովի անդամի օժանդակությամբ ձևական աճուրդ-վաճառք կազմակերպելու միջոցով մարզի բնակավայրերից մեկում գտնվող՝ համայնքային սեփականություն հանդիսացող հողամասը բնակչին օտարելու համար նրանից պահանջել և ստացել են 70.000 ՀՀ դրամ կաշառք: 

Բացի այդ, 2024 թվականի հուլիսին նույն մարզում գտնվող հողամասում բնակելի տուն կառուցելու նախագիծ կազմելու և շինարարության թույլտվությունն անխոչընդոտ տրամադրելու համար Հ. Դ.-ն հողամասի սեփականատիրոջից պահանջել և ստացել է 150.000 ՀՀ դրամ կաշառք:

Պարզվել է նաև, որ վերը նշված պաշտոնատար անձինք 2024 թվականի հոկտեմբերի 11-ին մեկ այլ քաղաքացուց պահանջել և ստացել են 55.000 ՀՀ դրամ կաշառք՝ նույն համայնքի բնակավայրում վերջինիս պատկանող հողամասի նպատակային նշանակությունը փոխելու դիմաց: 

Նախաքննությամբ հիմնավորվել է նաև, որ համայնքի ղեկավարի տեղակալ Ա. Հ.-ն 2024 թվականի հոկտեմբերի 22-ին կայանալիք՝ քաղաքին նվիրված տոնակատարության ժամանակ համայնքում բիզնես գործունեություն իրականացնող անձին մեդալով պարգևատրելու համար նրանից պահանջել և ստացել է  120.000 ՀՀ դրամ:

Խմբի կազմում կաշառք ստանալու համար վերը նշված պաշտոնատար անձանց՝ Ա. Հ.-ին և Հ. Դ.-ին, մեղադրանք է ներկայացվել ՀՀ քրեական օրենսգրքի 435-րդ հոդվածի 2-րդ մասի 1-ին և 3-րդ կետերով, 435-րդ հոդվածի 2-րդ մասի 1-ին կետով, 435-րդ հոդվածի 2-րդ մասի 1-ին և 3-րդ կետերով և 435-րդ հոդվածի   1-ին մասով: Նշված երկու մեղադրյալների նկատմամբ որպես խափանման միջոց է կիրառվել կալանքը: Եվս 8 անձի մեղադրանք է ներկայացվել կաշառք տալու և կաշառք ստանալուն օժանդակելու՝ ենթադրյալ հանցանքներ կատարելու հոդվածներով:

Քրեական վարույթով նախաքննությունն ավարտվել է: Դատախազի կողմից հաստատվել է մեղադրական եզրակացությունը, և վարույթի նյութերն ուղարկվել են դատարան՝ ըստ էության քննելու համար:

Ծանուցում.  հանցագործության համար մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
