Ռուբեն Վարդանյանի միջազգային փաստաբան Ջարեդ Գենսերի հայտարարությունը.

«Լեռնային Ղարաբաղի նախկին պետնախարար Ռուբեն Վարդանյանը մեկ շաբաթ առաջ դիմել է համարձակ քայլի՝ հացադուլ է հայտարարել ի նշան բողոքի Ադրբեջանում իր և մյուս հայ քաղբանտարկյալների նկատմամբ իրականացվող քաղաքական ցուցադրական դատավարության։

Վարդանյանի գործով «դատավարությունը» մեկնարկել է հունվարի 17-ին՝ մոտ 500 օր կամայական կալանքի տակ գտնվելուց հետո։ Նրան ոչ միայն սպառնում է ցմահ ազատազրկում քաղաքական դրդապատճառներով առաջադրված մեղադրանքների համար, այլև կոպտորեն խախտվել են նրա դատավարական իրավունքները:

Վարդանյանի դատավարությունը երեկ շարունակվել է՝ չնայած նրա առողջական վիճակի վատթարացմանը և դատավարությունը հետաձգելու բազմաթիվ միջնորդություններին։ Մասնավորապես, Ռուբենի զարկերակային ճնշումը եղել է վտանգավոր բարձր, ինչը պահանջել է բժշկական օգնություն։ Նրա զարկերակը նորմայից զգալիորեն բարձր է եղել: Նա հյուծված տեսք է ունեցել ու մի քանի անգամ ուշագնացության եզրին է եղել։

Չնայած առողջական լուրջ խնդիրներին, նրան, այնուամենայնիվ, ստիպել են կանգնել Բաքվի ռազմական դատարանի դատական կոլեգիայի առջև և մասնակցել նիստին, որը գաղտնի և դռնփակ է եղել: Հաշվի առնելով Ռուբենի առողջական վիճակը՝ պաշտպանական կողմը նախնական միջնորդություն է ներկայացրել՝ նիստը հետաձգելու մասին, իսկ դատական կոլեգիան ընդմիջում է հայտարարել՝ պետության նշանակած բժշկի կողմից բուժզննում անցնելու համար։ Այդ բժիշկը, սակայն, իր դիտարկումները հայտնել է դատարանին միայն մասնավոր կերպով, այլ ոչ թե պաշտոնապես լսումների ժամանակ, ինչն էլ լուրջ հարցեր է առաջացրել եզրակացությունների իրական լինելու վերաբերյալ: Դատական կազմը մերժել է դատավարությունը հետաձգելու առաջին միջնորդությունը, ինչպես նաև ևս չորսը՝ տարբեր պարբերականությամբ՝ պնդելով, թե Ռուբենի համար անվտանգ է մասնակցությունը նիստին, քանի որ նա նստած է։

Նելսոն Մանդելայի կանոնների 27-րդ կետի համաձայն՝ «կալանքի [բոլոր] վայրերը հրատապ դեպքերում պետք է ապահովեն բժշկական օգնության արագ հասանելիություն»։ Պարտադրել Ռուբենին մասնակցել այս դատավարությանը, երբ նրա առողջությանը և անվտանգությանը լրջագույն վտանգ է սպառնում, նվազագույնը դաժան, անմարդկային և արժանապատվությունը նվաստացնող վերաբերմունք է կամ պատիժ:

Ես կոչ եմ անում միջազգային բոլոր կազմակերպություններին, որոնք հասանելիություն ունեն Ադրբեջանի բանտարկյալներն, դիմել թույլտվություն ստանալու՝ Ռուբենին այցելելու համար: Բացի դրանից, խնդրում եմ անկախ դատական փորձագետներին հետևել Ռուբենի «դատավարությանը»՝ համոզվելու համար որ նրա իրավունքները լսումների ընթացքում հետայսու ևս չեն ոտնահարվի:

Ես կոչ եմ անում Ադրբեջանի կառավարությանը՝ թույլ տալ մեր միջազգային թիմի բժշկին այցելելու նրան, անհապաղ կերպով ապահովելու անհրաժեշտ բժշկական օգնությամբ, ներառյալ նրա առողջական վիճակի մոնիտորինգը, որի կարիքը նա ունի, ինչպես նաև հետաձգել դատավարությունը մինչև հացադուլի դադարեցումը:

Ես նաև կոչ եմ անում աշխարհի առաջնորդներին, Հայաստանի վարչապետ Նիկոլ Փաշինյանին, դատապարտել այս ցուցադրական դատավարությունը, այն որակել որպես քաղաքական և ապօրինի»:
