Ովքե՞ր պետք է պարգևատրական զենքերը հանձնեն ոստիկանությանը, և ովքե՞ր կարող են դրանք պահել իրենց մոտ. «Փաստ»

«Փաստ» օրաթերթը գրում է.

Ներքին գործերի նախարարությունն առաջարկում է փոփոխություններ և լրացումներ կատարել «Զենքի շրջանառության կարգավորման մասին» օրենքում: Նախագծով նախատեսվում է պարգևատրական զենքերի հատկացման գործընթացը համապատասխանեցնել գործող օրենսդրությամբ սահմանված՝ ստանդարտ ունեցող կանոններին և բացառել երկակի մոտեցումների կիրառումը։

Առաջարկվում է վերացնել գործող օրենսդրության հիմնական և անցումային դրույթներում պարգևատրական զենքերի մասով առկա՝ պետության համար անկանխատեսելի և երկակի մոտեցումներ նախատեսող իրավիճակները։ Ըստ այդմ՝ պարգևատրական մեկ միավոր զենքը կարող է շարունակել մնալ անձի օրինական տիրապետման տակ, եթե տիրապետողը Հայաստանի Հանրապետության քաղաքացի է և ունի ՀՀ պետական ռազմականացված կազմակերպություններում 20 և ավելի տարի ծառայության ստաժ և առնվազն «մայոր» կոչում կամ դրան հավասարեցված դասային աստիճան։ Նշված նախապայմանների առկայության դեպքում անձի մոտ պարգևատրական զենք թողնելը իրավաչափ է և համահունչ գործող օրենսդրությամբ ընդունված չափորոշիչներին, քանի որ գործող օրենսդրությունն արդեն իսկ ճանաչել է այդպիսի անձի համար մեկ միավոր ծառայողական զենք ձեռք բերելու իրավունքը։ Եթե նշված նախապայմաններին բավարարող անձը զենքով պարգևատրվել է մեկից ավելի անգամ, ապա երկրորդ և հաջորդ միավոր պարգևատրական զենքերը պետք է հանձնի ոստիկանություն, քանի որ օրենքով նախատեսված կարգավորումը նախատեսում է ընդամենը մեկ միավոր ծառայողական զենքի ձեռքբերման հնարավորություն։

Նախատեսվում է պետության համար անկանխատեսելի և երկակի մոտեցումներ նախատեսող կարգավորումների ուժով զենքով պարգևատրված բոլոր անձանց տրամադրել ժամկետ՝ մինչև 2025 թ. հուլիսի 1-ը՝ պարգևատրական զենքերը ոստիկանություն ներկայացնելու համար։ Սահմանված ժամկետում պարգևատրական զենքերը ոստիկանություն ներկայացնելը չի առաջացնի որևէ բացասական հետևանք, այդ թվում՝ քրեաիրավական հետևանքներ։ Սահմանված ժամկետում զենքը կամ 1-ին կետով նախատեսված հիմքերը չներկայացնելու դեպքերը կդիտարկվեն քրեական օրենսգրքի 335-րդ հոդվածով նախատեսված հանցակազմի համատեքստում, ինչը հիմք կհանդիսանա քրեական վարույթ նախաձեռնելու համար։

Առաջարկվում է պարգևատրման ինստիտուտում պահպանել գործող օրենքում առկա՝ ստանդարտ ունեցող միակ եղանակը, այն է՝ օրենքով սահմանված չափորոշիչների բավարարման դեպքում վարչապետի կողմից պարգևատրումը։ Նախատեսվում է ստեղծել իրավական հնարավորություն, որպեսզի ոստիկանություն ներկայացված, ոստիկանության կողմից առգրավված կամ վերցված պարգևատրական զենքերն օգտագործվեն նաև գիտակրթական կամ մշակութային նպատակներով։
