Սամվել Խ․-ն իր հարևանությամբ բնակվող Սերոժ Գ․-ին կասկածելով կնոջը՝ Մ․ Սաֆարյանին սիրահետելու մեջ, մասնավորապես՝ շենքի բակից իրենց տան պատուհաններին հաճախակի նայելու համար, նրան պատժելու նպատակով իր հետ վերցրել է խոհանոցային դանակների նմանությամբ պատրաստված փայտե բռնակով դանակը, ապա վերջինիս առանձին դաժանությամբ կյանքից զրկելու դիտավությամբ 3 անգամ հարվածներ է հասցրել Սերոժ Գ․-ին։ Այս մասին Iravaban.net-ը տեղեկանում է «Դատալեքս» դատական-տեղեկատվական համակարգից։
Նշվում է, որ սպանության պահին ներկա են եղել Սերոժ Գ․-ի հարսը, 10-ամյա թոռնուհին, իսկ սպանվածի գրկին մանկահասակ երեխա է եղել։ Սամվել Խ․-ն հնչեցրել է՝ «Սերոժ, հազար անգամ քեզ ասել եմ՝ իմ կողմը չնայես, քեզ կսատկացնեմ» արտահայտությունները, այնուհետև հարվածներից 2-ը հասցրել սպանվածի որովայնին, իսկ 1-ը՝ ձախ սրունքի վերին երրորդականին։ Սերոժ Գ․-ի մոտ առաջացել է տրավմատիկ, հեմոռռագիկ շոկ ու որն էլ հանգեցրել է նրա մահվան։
Գործը մակագրվել է Արարատի և Վայոց ձորի մարզերի ընդհանուր իրավասության դատարանի դատավոր Նարեկ Բեգլարյանին, որն էլ որոշել է Սամվել Խ․-ի նկատմամբ ընտրված խափանման միջոցը երկարաձգել մինչև մարտի 21-ը։
Դատարանի համոզմամբ հիմնավոր են քննիչի միջնորդությամբ ներկայացված մեղադրյալի կողմից իր վրա դրված պարտականությունները չկատարելու, քրեական վարույթին խոչընդոտելու, այդ թվում ապացուցման գործընթացին ապօրինի միջամտելու վերաբերյալ պատճառաբանությունները, քանի որ ազատության մեջ գտնվելով մեղադրյալ Սամվել Խ․-ն կարող է անմիջականորեն կամ միջնորդավորված կերպով ճնշումներ կամ անօրինական այլ ազդեցություն գործադրել վարույթի շրջանակներում հարցաքննված անձանց նկատմամբ՝ իր դեմ ցուցմունքներ չտալու, արդեն իսկ տված ցուցմունքներում նշված տեղեկություններն այլափոխելու, դեպքի իրական հանգամանքները թաքցնելու նպատակով՝ այդ կերպ դրսևորելով ոչ իրավաչափ վարքագիծ:
«․․․Դատարանն արձանագրում է, որ գործով ձեռք չեն բերվել այնպիսի նոր փաստական տվյալներ, որոնք չեզոքացնում են նախկինում մատնանշված՝ մեղադրյալին կալանքի տակ պահելու հիմնավորումները, ուստի մեղադրյալի նկատմամբ ընտրված խափանման միջոցը՝ կալանքը, վերացնելու կամ փոխելու փաստական հիմքեր չկան: Ամփոփելով ասվածը՝ դատարանը եզրահանգում է, որ մեղադրյալի նկատմամբ ընտրված խափանման միջոցի՝ կալանքի ժամկետը պետք է երկարաձգել 3 ամսով՝ մինչև 2025 թվականի մարտի 21-ը»,-նշվում է որոշման մեջ:
Գործով հիմնական դատալսումները մեկնարկեն փետրվարի 21-ին։
Ծանուցում. հանցագործության համար մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ Քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
