POLITICS«Այն ավելի շատ կորակեի որպես հանրությանը հաճոյանալու պոպուլիստական նախաձեռնություն»-ԱԺ-ում ելույթ ունենալով ՀՀ-ի ԵՄ-ին անդամակցելու գործընթացի մեկնարկի մասին հանրային օրինագծի քննարկման ժամանակ ասաց «Հայաստան» խմբակցության պատգամավոր Լիլիթ Գալստյանը։
Նկատելով, որ այն գիտակցել են նաև օրինագծի հեղինակները՝ պատգամավորը նշեց, որ այդ պատճառով է․ օրենքում կիրառվել է «Հռչակել» բառը՝ «Հայաստանի Հանրապետությունը հռչակում է ԵՄ-ին անդամակցելու գործընթացը» հայտարարության մեջ։
Նա հայտնեց, որ չի ցանկանում, որ ՀՀ-ի կողմից կատարվի մի հաստատում և ԱԺ-ն ընդունի մի փաստաթուղթ, որի լրջությունն ու հիմնակվորումներն այս պահին խոցելի են։
Նշելով, որ հռետորահրապարակախոսական այդ նախադասությունը չի կարող օրենք կոչվել՝ Գալստյանը հիմնավորեց, որ բացակայում են օրենքի կարգավորման առարկան և հասցեատերը և բացակայում է պատասխանատվության նորմը , թե ով է պատասխանատվություն կրում օրենքի չկատարման համար։
Ըստ Գալստյանի, դրանք իրավագիտական տարրական պահանջներ են, որոնք հասում են իրավաբանական ֆակուլտետի առաջին յուրաքանչյուր կուրսի ուսանողներին։
Նա նշեց, որ նախագիծը սին սպասումներ է առաջացնում հասարակության մոտ, թե օրենքի ընդունումն անշրջելի կդարձնի ժողովրդավարությունը, օրենքի գերակայությունը, կվերականգնի պետության քաղաքականության կանխատեսելիության նկատմամբ հավատն ու վստահությունը, կնպաստի տարածաշրջանում խաղաղության և կայունության հաստամանը և ուժերի հավասարակշռման միջոցով ՀՀ անվտանգության հնարավորությունների մեծացմանը։
«Իսկ մեր հարևան Օնիկն էլ համոզված է, թե վաղվանից շենգեն վիզա է ստանալու»,- հայտարարեց Գալստյանը և նկատելով, որ ոչ օրենքները ոչ իղձերն ու ցանկությունները չեն կանխորոշում ԵՄ-ին անդամակցությունը և հավելեց. «Ոչ էլ անդամակցության մեկնարկը հռչակագրային բնույթ ունի...Իղձը և ցանկությոընը չի կարող օրենք լինել»։
Նա նշեց, որ քննարկվողը օրենք չէ և հակասում է ՀՀ Սահմանադրությանը։
