Քաղաքական իրավունքների հայկական կենտրոնը տարածել է հայտարարություն՝ արցախցի գիտնական Ղարիբ Բաբայանի նկատմամբ քրեական հետապնդման վերաբերյալ․
«Հայտարարություն Ղարիբ Բաբայանի քաաղաքական հետապնդման մասին․
Փետրվարի 1-ին գիտնական Ղարիբ Բաբայանի նկատմամբ հարուցված քրեական հետապնդումը և հրապարակային խոսքը սահմանափակող խափանման միջոցի կիրառումը իրավական կամայականություն է՝ հիմնված «ատելության խոսքի» սխալ և խտրական մեկնաբանության վրա` հակասելով Հայաստանի Հանրապետության Սահմանադրությանը և մարդու իրավունքների միջազգային չափանիշներին։
Ատելության խոսքի անբաժան մասը պաշտպանվող հատկանիշն է՝ այն հատկանիշը, որով պայմանավորված է ատելությունը, օրինակ՝ մարդու մաշկի գույնը, կրոնական հայացքները և այլն։ Առաջին դեպքը չէ, երբ քաղաքական վերնախավին կամ իշխող կուսակցության պատկանելիությունը նույնացվում է «քաղաքական հայացքների» հետ, ինչը պարզունակ է դարձնում և խեղաթյուրում այդ հասկացությունը՝ վերածելով այն քաղաքական հետապնդման գործիքի։
Իշխող վերնախավին պատկանելը չի կարող պաշտպանվող հատկանիշ լինել, առավել ևս այնպիսի կուսակցության միանձյա իշխանության պարագայում, որը բազմիցս հայտարարել է, որ զերծ է որևէ «իզմ»-երից, այսինքն՝ չի կրում որևէ որոշակի քաղաքական գաղափարախոսություն։
Խոսքի ազատությունը հիմնական և կարևորագույն քաղաքական իրավունքներից է։
Քաղաքական խիստ քննադատության դուր չգալը որոշակի խմբին ոչ թե խնդիր է, այլ բազմակարծության երաշխիք։ Եթե քաղաքական քննադատության «թույլատրելի շեմը» իջեցվում է այս մակարդակի, ապա մարդիկ ստիպված են իրականացնել այնպիսի ինքնագրաքննություն, որը հատուկ է բացառապես բռնապետություններին։
Քննադատական գրառման համար Ղարիբ Բաբայանի դեմ քրեական հետապնդման հարուցումը և խափանման միջոցի կիրառումը ինքնին բավարար են այդ գործը քաղաքական հետապնդում որակելու համար։
Քաղաքական իրավունքների հայկական կենտրոնը այժմ պատրաստում է հատուկ զեկույց՝ Հայաստանի Հանրապետությունում ատելության խոսքի (ՀՀ ՔՕ 329 և 330-րդ հոդվածներ) կիրառման միակողմանի և խտրական պրակտիկայի, կամայական մեկնաբանությունների և մյուս խնդիրների մասին»։
