Ե՞րբ և ի՞նչ կարգով է վճարվում քաղաքացու կենսաթոշակը՝ ՀՀ-ից բացակայելու դեպքում

Եթե կենսաթոշակն անկանխիկ եղանակով ստացող կենսաթոշակառուն սահմանված ժամանակահատվածում (տարեկան մեկ անգամ) չի ներկայացել բանկ՝ ՀՀ-ում լինելու մասին հայտարարություն ստորագրելու համար, ապա վերջին անգամ բանկ ներկայանալու ամսվան հաջորդող ամսվա 1-ից կենսաթոշակի վճարումը դադարեցվում է։ Այս մասին հայտնում են Աշխատանքի և սոցիալական հարցերի նախարարությունից։

Այս դեպքում, կենսաթոշակի վճարումը կվերսկսվի, եթե քաղաքացին կենսաթոշակի վճարումը դադարեցնելու ամսվանից 12 ամսվա ընթացքում ներկայանա բանկ կամ անձամբ դիմի Միասնական սոցիալական ծառայության ցանկացած տարածքային բաժին։

  • Եթե կենսաթոշակը կանխիկ եղանակով ստացող քաղաքացին 12 ամիս անընդմեջ չի ստացել կենսաթոշակ, ապա 12 ամսվան հաջորդող ամսվա 1-ից կենսաթոշակի վճարումը դադարեցվում է։ Կենսաթոշակի վճարումը վերսկսելու համար քաղաքացին անձամբ պետք է դիմի Միասնական սոցիալական ծառայության ցանկացած տարածքային բաժին։

Ընդ որում, կենսաթոշակի վճարումը վերսկսվելու դեպքում չվճարված կենսաթոշակը կտրամադրվի դիմելու ամսվան նախորդող մեկ տարվա այն ժամանակահատվածի համար, որի ընթացքում անձը կենսաթոշակ ստանալու իրավունք է ունեցել։

  • Եթե կենսաթոշակի վճարումը դադարեցված չէ, ապա կենսաթոշակը կարող է վճարվել նաև կենսաթոշակառուի կողմից տրված և նոտարի վավերացրած լիազորագրով։

Կենսաթոշակը լիազորագրով անընդմեջ կարող է վճարվել տասներկու ամսից ոչ ավելի ժամանակահատվածում` սկսած կենսաթոշակը լիազորագրով վճարելու ամսից, բայց ոչ ավելի, քան լիազորագրի գործողության դադարումը: Լիազորագիրը տալու ամսվան հաջորդող տասներկուերորդ ամսվանից հետո կենսաթոշակը տվյալ լիազորագրով չի վճարվում: Հարկ է նշել, որ վերալիազորման կարգով տրված լիազորագրով կենսաթոշակ չի վճարվում:

Կենսաթոշակի վճարումը դադարեցված լինելու դեպքում՝ չվճարված կենսաթոշակի գումարը լիազորագրով չի վճարվում, բացառությամբ անձի՝ քրեակատարողական հիմնարկում պատիժը կրելու, հոգեբուժական հաստատությունում բուժվելու, պարտադիր ժամկետային զինվորական ծառայության զորակոչվելու կամ ՀՀ հետ կենսաթոշակային ապահովության բնագավառում միջազգային պայմանագիր կնքած պետություններ մշտական բնակության մեկնող (մեկնած) անձի կենսաթոշակի գործն ուղարկելու դեպքերի:
