Մարդու իրավունքների պաշտպանի աշխատակազմում վերջին շրջանում բազմաթիվ ահազանգեր են ստացվում իրավասու մարմինների կողմից քրեակատարողական հիմնարկներում ազատությունից զրկված անձանց հացադուլի պատշաճ վարմանն առնչվող շարունակական խնդիրների առնչությամբ: Ի թիվս այլնի, բարձրացվում են ստացիոնար բժշկական օգնության հասանելիությանը վերաբերելի հարցեր: Այս մասին հայտնում են ՀՀ Մարդու իրավունքների պաշտպանի գրասենյակից:

«Պաշտպան Անահիտ Մանասյանը մտահոգիչ է համարում ստացիոնար բուժման անհրաժեշտություն ունեցող հացադուլ հայտարարած անձանց «Դատապարտյալների հիվանդանոց» քրեակատարողական հիմնարկ կամ առողջապահական մարմինների բուժական հիմնարկ տեղափոխման անհարկի ձգձգումները, ինչը երբեմն անդառնալի հետևանքներ է ունենում։

Այսպես, Մարդու իրավունքների պաշտպանի աշխատակազմ ահազանգ է ստացվել 20 օր հացադուլում գտնվող ազատությունից զրկված անձի մահվան առնչությամբ։ ՄԻՊ աշխատակազմը վերջինիս ստացիոնար բուժման անհրաժեշտության հարցը տարբեր ձևաչափերով անընդհատ քննարկել է «Քրեակատարողական բժշկության կենտրոն» ՊՈԱԿ-ի հետ։

Պաշտպանն ընդգծում է, որ ազատությունից զրկված կամ այլ կերպ պետության իրավասության ներքո գտնվող անձանց իրավունքների ապահովման համար պետությունը կրում է պատասխանատվություն:

Իրավասու պետական մարմինները պարտավոր են ձեռնարկել բոլոր միջոցառումները նրանց իրավունքների խախտումները կանխարգելելու, ինչպես նաև մահվան դեպքերի առնչությամբ նախաձեռնված քրեական վարույթների բազմակողմանի, լրիվ և օբյեկտիվ քննությունն ապահովելու համար:

Պաշտպանը մտահոգիչ է համարում նաև այն հանգամանքը, որ ազատությունից զրկված անձինք քրեակատարողական հիմնարկներում իրենց բողոքը հաճախ արտահայտում են ինքնավնասումներ կատարելու ճանապարհով, այդ թվում` օտար մարմիններ կուլ տալու եղանակով, որոնք որևէ կերպ հասանելի են դառնում ազատությունից զրկված անձանց: Մարդու իրավունքների պաշտպանը ևս մեկ անգամ շեշտադրում է, որ իրավասու մարմինները պետք է ակտիվ միջոցառումներ ձեռնարկեն այդ հանգամանքները կանխարգելելու ուղղությամբ:

Վերոնշյալ խնդիրներին Մարդու իրավունքների պաշտպանն անդրադարձել է բազմիցս՝ ինչպես հրապարակային ելույթներում, այնպես էլ տարբեր քննարկումների ընթացքում։ Թեման մանրամասն վերլուծվել է նաև Կանխարգելման ազգային մեխանիզմի 2023 թվականի տարեկան հաղորդման շրջանակներում։

Ազատությունից զրկման վայրերում կյանքի և առողջության պահպանման իրավունքների ապահովման հարցերը մշտապես գտնվում են Մարդու իրավունքների պաշտպանի անմիջական ուշադրության ներքո: Դրանք մանրամասն վերլուծվում են Պաշտպանի կողմից, համապատասխան առաջարկները ներկայացվում են իրավասու մարմիններին՝ ոլորտը բարելավելու նպատակով»:
