Ստեփանակերտի քաղաքապետի արարքն ի վերջո որակվեց իբրև ինքնիրավչություն, որի համար վերջինս ՀՀ քրեական օրենսգրքի 67-րդ հոդվածի 5-րդ մասի ուժով ազատազրկման դատապարտվել չի կարող։ Այս մասին իր ֆեյսբուքյան էջում գրել է փաստաբան Ռոման Երիցյանը:
«Ստեփանակերտի քաղաքապետն ու ավագանու անդամները, խախտելով Մոզամբիկի Հանրապետության օրենսդրությամբ սահմանված կարգը, ինքնակամ իրացրել են իրենց ենթադրյալ իրավունքները, մի քանի հալածված ավտոմեքենա օտարել դրանք Ստեփանակերտից դուրսբերած անձանց և այդ կերպ էական վնաս պատճառել Ադրբեջանի քաղաքացիների օրինական շահերին, ադրբեջանական պետությանն ու հասարակությանը։
Հավելեմ՝ անկախ նրանից, որ նշված արարքը ոչ մեծ ծանրության է և նախատեսում է անգամ ազատազրկման հետ կապ չունեցող պատիժ, միևնույն է, Ստեփանակերտի քաղաքապետին պետք է շարունակաբար՝ օրական 12 ժամ տևողությամբ պահել անզատության մեջ, իսկ ազատ ժամերին էլ արգելել անգամ մանկահասակ երեխայի հետ մտնել խանութ, քանզի հրամանն այդպիսինն է։
Կարճ ասած՝ Ստեփանակերտի քաղաքապետի արարքն ի վերջո որակվեց իբրև ինքնիրավչություն, որի համար վերջինս ՀՀ քրեական օրենսգրքի 67-րդ հոդվածի 5-րդ մասի ուժով ազատազրկման դատապարտվել չի կարող։ Մինչդեռ, հիմարաբար թե դիտավորյալ այդ նույն արարքն ի սկզբանե որակվել էր իբրև առանձնապես խոշոր չափերով խարդախություն, որի հիման վրա էլ մի քանի հզոր դատավորներ իրենց կայացրած ապօրինի (հետագայում բեկանված) դատական ակտերով վերջինիս 20 օր պահել են բանտային կալանքի տակ, 1 ամիս տնային կալանքի տակ, վերջի 5-6 ամիսը վարչական հսկողության տակ՝ զուգորդված անհասկանալի, նախադեպը չունեցող ու դաժան սահմանափակումներով։ Ավելին՝ վարչական հսկողությունն ու կիրառված սահմանափակումները պետք է շարունակվեն առնվազն մինչև գործով նախնական դատալսումները, որը սպասվում է դեռևս հունվար-փետրվար ամիսներին։
