Սոնա Մնացականյանի գործով Փաշինյանի ավտոշարասյան ղեկավար կազմի նկատմամբ քրեական հետապնդում չհարուցելն անօրինական է համարվել

Փաշինյանի ավտոշարասյան ղեկավար կազմի նկատմամբ քրեական հետապնդում չհարուցելն անօրինական է համարվել: Այս մասին իր ֆեյսբուքյան էջում գրել է Սոնա Մնացականյանի ընտանիքի շահերի պաշտպան, փաստաբան Րաֆֆի Ասլանյանը:
«Երևան քաղաքի ընդհանուր իրավասության դատարանը՝ նախագահությամբ դատավոր Մասիս Մելքոնյանի, բավարարել է Սոնա Մնացականյանին վրաերթի ենթարկելու դեպքով ՀՀ վարչապետի ավտոշարասյան ղեկավար կազմի նկատմամբ քրեական հետապնդում չհարուցելու մասին հսկող դատախազի որոշման դեմ իմ կողմից ներկայացված բողոքը՝ այդ որոշումը համարելով անօրինական և վարույթի հանրային մասնակիցներին պարտավորեցնելով նոր քննությամբ վերացնել տուժողի իրավունքների խախտումը»,-գրել է Րաֆֆի Ասլանյանը:
Հիշեցնենք, որ Սոնա Մնացականյանը վրաերթի էր ենթարկվել 2022-ի ապրիլի 26-ին Երևանի Լեո-Պարոնյան փողոցի խաչմերուկում: Հղիության 8-րդ ամսում գտնվող կնոջը վրաերթի էր ենթարկել Փաշինյանին ուղեկցող ոստիկանական մեքենաներից մեկը: Կնոջը հիվանդանոց էին հասցրել արդեն մահացած։
Սոնային վրաերթի ենթարկողը ՃՈ ուղեկցող սպայական վաշտի հրամանատար, ոստիկանության մայոր Արամ Նավասարդյանն էր: Արամ Նավասարդյանի մեղադրանքում նշված է, որ նա իրեն ամրակցված «Տոյոտա Պրադո» մակնիշի ավտոմեքենան վարել է սահմանված 100 կմ/ժ արագությունը գերազանցող՝ նվազագույնը շուրջ 108.7 կմ/ժ արագությամբ։
«Երթևեկության համար վտանգն առաջանալու պահից սկսած, որը նա ի վիճակի է եղել հայտնաբերել, միջոցներ չի ձեռնարկել արագությունը իջեցնելու՝ ընդհուպ մինչև տրանսպորտային միջոցը կանգնեցնելը։ Ժամանակին չդիմելով արգելակման՝ ստեղծել է վթարային իրադրություն և ավտոմեքենայի առջևի աջ մասով վրաերթի է ենթարկել հետիոտների համար նախատեսված լուսացույցի կանաչ լույսի առկայության պայմաններում իր ընթացքի ուղղությամբ՝ ձախից դեպի աջ հանգիստ քայլերով հետիոտնային նշագծումների վրայով Պարոնյան փողոցը հատող 31-շաբաթական հղիություն ունեցող հետիոտն Սոնա Մնացականի Մնացականյանին, որի հետևանքով վերջինիս անզգուշությամբ պատճառել է մահ, դրանով իսկ պայմանավորել տվյալ վրաերթի առաջացումը՝ ինքն իրեն զրկելով այն կանխելու տեխնիկական հնարավորությունից»,- ասված է մեղադրանքում։
