Կրկին գրություններ եմ ուղարկել իմ միջազգային գործընկերներին և մի շարք միջազգային կազմակերպությունների` Հովիկ Աղազարյանի մասով: Այս մասին իր էջում գրել է ԱԺ մարդու իրավունքների պաշտպանության և հանրային հարցերի մշտական հանձնաժողովի՝ ապօրինաբար լիազորությունները դադարեցված նախագահ, անկուսակցական պատգամավոր Թագուհի Թովմասյանը:

Նա, մասնավորապես, նշել է. «Որպես Մարդու իրավունքների պաշտպանությամբ զբաղվող Հայաստանի խորհրդարանի ներկայացուցիչ, իմ պարտքն եմ համարում անդրադառնալ ԱԺ պատգամավոր Հովիկ Աղազարյանի հետ կատարվածին:

Ունենալով մարդկային, գաղափարական և քաղաքական ծայրահեղ հակասություններ նույն պատգամավորի հետ, այնուամենայնիվ, համարում եմ, որ մարդու անձնական հեռախոսազրույցները, նամակագրություններն առանձնացնելը և քաղաքական թիմի անդամներին դրանց հետ ծանոթանալու հնարավորություն ընձեռնելը, անձնական տվյալների պաշտպանության տեսանկյունից, խիստ խնդրահարույց է և անընդունելի:

Այդ արտահոսքը խախտում է ազգային օրենսդրությունը և միջազգային իրավունքի մի շարք նորմեր.

  2. Քաղաքացիական և քաղաքական իրավունքների մասին միջազգային դաշնագիր - 1966
  3. Եվրոպական կոնվենցիա մարդու իրավունքների և հիմնարար ազատությունների պաշտպանության մասին - 1950
  4. Ընդհանուր տվյալների պաշտպանության կանոնակարգ (GDPR) (2016/679) - 2016

ՀՀ Սահմանադրության 33 և 34-րդ հոդվածները հստակ սահմանում են, որ յուրաքանչյուր ոք ունի նամակագրության, հեռախոսային խոսակցությունների և հաղորդակցության այլ ձևերի ազատության և գաղտնիության իրավունք:

Առավել անընդունելի է, որ ՀՀ վարչապետի աշխատակազմի ղեկավար Տարոն Չախոյանին փոխկապակցված կայքում պատգամավորի սեռական կողմնորոշման մասին «բացահայտումներ են արվել»՝ նույն հեռախոսային տեղեկությունների հղումով:

Աղազարյանի հետ կատարվածը վկայում է ոչ միայն այն մասին, որ խախտվել է նրա անձնական տվյալների պաշտպանության սկզբունքը, այլ նաև տպավորություն է, որ Կառավարության աշխատակազմից ուղղորդված թիրախավորման արշավ է սկսվել պատգամավորի դեմ:

Իմ միջազգային գործընկերներից ու տարբեր կազմակերպություններից ակնկալում եմ համապատասխան արձագանք, քանի որ նախկինում իրավունքների ամենաչնչին ոտնհարման դեպքերով օտարերկրյա դեսպանները, տեսաուղերձով, նույնիսկ դատապարտում էին տեղի ունեցածը: Հիմա՝ մի տեսակ լուռ են:
