Տղամարդը, որը 27 տարի բանտում էր անցկացրել չկատարած սպանության համար, ստացել է 13 մլն դոլարի փոխհատուցում

Ճաղերի հետեւում անցկացրած 27 տարիների ընթացքում մահացել են Մայքլ Սալիվանի մայրը, չորս եղբայրները եւ քույրերը, ընկերուհին հեռացել է նրանից, իսկ ինքը քանիցս դաժանաբար ծեծի է ենթարկվել բանտում, գրել է Associated Press-ը։
Եվ այդ ամենը՝ սպանության համար, որը, ինչպես նա երկար ժամանակ պնդում էր, երբեք չէր կատարել։
Այս ամիս 64-ամյա Սալիվանը հասավ արդարության, երբ Մասաչուսեթսի նահանգի ատենակալները վճռեցին, որ նա անմեղ է եւ չի մասնակցել Ուիլֆրեդ Մակգրաթի սպանությանն ու թալանին 1986թ.։
Նրան տրվել է 13 մլն դոլարի փոխհատուցում, չնայած նահանգի օրենքները սահմանափակում են վճարումը 1 մլն դոլարի չափով անիրավաչափ մեղադրանքների համար։
Ատենակալները նաեւ խոստովանել են, որ քիմիկոսը նահանգի ոստիկանությունից կեղծ ցուցմունքներ է տվել դատարանում։ Սալիվանը մեղավոր է ճանաչվել սպանության ու կողոպուտի մեջ 1987թ., այն բանից հետո, երբ ոստիկանությունը տեղեկացրել է, որ Մակգրաթը թալանվել է եւ մահու չափ ծեծի ենթարկվել։ Իշխանությունները Սալիվանի վրա կենտրոնացել են այն բանից հետո, երբ իմացել են, որ նրա քույրը հանդիպում էր Մակգրաթի հետ սպանությունից առաջ, եւ նրանք երկուսով գնացել են այն բնակարան, որը նա կիսում էր Սալիվանի հետ։
Սպանության մեջ մեկ այլ կասկածյալ՝ Գերի Գրեյսը, մեղադրել է Սալիվանին, եւ նրա վրայից հանել են սպանության մեղադրանքները։ Սալիվանը մեղավոր է ճանաչվել եւ դատապարտվել ցմահ բանտարկության։
Իսկ Գրեյսը մեղավոր է ճանաչվել սպանությանը մասնակցելու մեջ եւ դատապարտվել է 6 տարվա ազատազրկման։ Էմիլ Պետրկան, որը ծեծել էր Մակգրաթին եւ օգնել ազատվել նրա մարմնից, մեղավոր է ճանաչվել երկրորդ աստիճանի սպանության մեջ։ Նա դատապարտվել է ցմահ բանտարկության՝ պայմանական վաղաժամ ազատման հնարավորությամբ, բայց մահացել է բանտում։
Բայց 2011թ. Սալիվանի փաստաբանը խնդրել է ԴՆԹ ուսումնասիրություն կատարել, որն անհասանելի է եղել առաջին դատավարության ժամանակ, որի արդյունքներով պարզվել է, որ Սալիվանը մեղավոր չէ։
2012թ. նշանակվել է նոր դատաքննություն, եւ Սալիվանը ազատ է արձակվել 2013թ.։
2014թ. Գերագույն դատարանը ուժի մեջ է թողել Սալիվանի գործով նոր դատաքննության անցկացման մասին որոշումը, իսկ 2019թ. նահանգի իշխանությունները հրաժարվել են գործի կրկնակի քննությունից։
Միդլսեքսի օկրուգային դատախազ Մերիան Ռայանը հայտնել է, որ իր գերատեսչության համար գրեթե անհնար էր հաջողությամբ կրկնել Սալիվանի գործի քննությունը՝ հաշվի առնելով վկաների մահը կամ հիշողության վատացումը։
