Պուտինն օտարերկրացիների հետ կեղծ ամուսնությունների դեմ պայքարելու մասին օրենք է ստորագրել

ՌԴ նախագահ Վլադիմիր Պուտինն օրենք է ստորագրել, ըստ որի օտարերկրացիները կարող են պարզեցված ձևով ժամանակավոր կացության թույլտվություն (TRP) ստանալ միայն Ռուսաստանի քաղաքացու հետ երեք տարվա ամուսնությունից հետո, հայտնում է ТАСС-ը։
Համապատասխան փաստաթուղթը հրապարակվել է, այն ուղղված է միգրանտների հետ ֆիկտիվ ամուսնություններին հակազդելուն։ Փոփոխություններ են կատարվում «Ռուսաստանի Դաշնությունից դուրս գալու և Ռուսաստանի Դաշնություն մուտք գործելու կարգի մասին» և «Ռուսաստանի Դաշնությունում օտարերկրյա քաղաքացիների իրավական կարգավիճակի մասին» օրենքներում։
Հրապարակված տեղեկատվության համաձայն՝ օտարերկրացիները երբեմն նման ամուսնությունների են դիմում միգրացիոն կարգավիճակ ստանալու համար և առանց ընտանիք կազմելու իրական մտադրության։ Մինչ օրս օրենսդրությունը չի սահմանել պարզեցված կարգով ժամանակավոր կացության թույլտվության համար դիմելու համար ամուսնացած լինելու ժամկետը։
Այժմ, պարզեցված ընթացակարգով, նման թույլտվություն կարող է տրվել օտարերկրացուն, ով առնվազն երեք տարի ամուսնացած է ՌԴ քաղաքացու հետ, ով մշտապես բնակվում է Ռուսաստանի Դաշնությունում: Այն կարող է տրամադրվել նաև, եթե կա ընդհանուր երեխա Ռուսաստանի Դաշնության քաղաքացի ամուսնու հետ:
Սակայն, եթե ամուսնությունը դատարանի կողմից լուծարվում կամ անվավեր է ճանաչվում, եթե օտարերկրացին զրկված է ծնողական իրավունքներից, սահմանափակվում է դրանցով կամ դուրս է գրվում երեխայի ծննդյան վկայականից, թույլտվությունը կարող է չեղարկվել։
Բացի այդ, հստակեցվում են առանց ժամանակավոր կացության թույլտվություն ստանալու կացության թույլտվություն տալու պայմանները։ Որպես կանոն, օտարերկրացիները կարող են դիմել կացության թույլտվության համար՝ Ռուսաստանում առնվազն ութ ամիս մնալուց հետո՝ ժամանակավոր կացության թույլտվության հիման վրա:
Բայց որոշ դեպքերում կարելի է անմիջապես կացության թույլտվություն ստանալ: Խոսքը, մասնավորապես, վերաբերում է այն միգրանտներին, որոնց երեխան Ռուսաստանի քաղաքացիություն ունի և բնակվում է Ռուսաստանի Դաշնությունում։ Փոփոխությունների համաձայն՝ եթե երեխա չի ծնվում ամուսնության մեջ, ապա կացության թույլտվություն ստանալու համար օտարերկրացիները պետք է դատարանում ապացուցեն նույն ընտանիքում ապրելու, պահպանմանն ու դաստիարակությանը մասնակցելու փաստը։
Մեկ այլ կետ վերաբերում է «ընտանիքի վերամիավորման իրավունքի ապահովմանը»։ Օրենքը երկարացնում է մինչև մեկ տարի սովորական մասնավոր վիզա օտարերկրացու համար, ով Ռուսաստանի Դաշնության քաղաքացու մերձավոր ազգականն է:
