Սարգիս Հ․-ն ֆիզիկական բռնություն է գործադրել Վայոց ձորի մարզում իր ծառայությունը բերող հոգևորականի նկատմամբ։ Նա 2023 թվականի փետրվարի 9-ին՝ ժամը 15:00-ի սահմաններում, Վայոց ձորի մարզի Ջերմուկ քաղաքում վերակառուցվող առողջարանային համալիրներից մեկում, առանց թույլտվության մուտք գործելու և ներսում լուսանկարահանում կատարելու, արդեն իսկ կատարած լուսանկարները ջնջելու հարցերի առնչությամբ վիճաբանել է հոգևորականի հետ։ Ձեռքերով և ոտքերով բազմաթիվ հարվածներ է հասցրել նրա մարմնի տարեր մասերին, քաշել է նրա մազերից ու մորուքից, ապա շարունակելով նրա հետ վիճաբանությունն առողջարանի բակում՝ բռունցքով հարվածել է նրա դեմքի շրջանում՝ այդ կերպ ֆիզիկական ներգործություն գործադրելով նրա նկատմամբ։

Գործը դատարան է ստացվել ապրիլի 17-ին և մակագրվել դատավոր Բորիս Բախշիյանին։ Սարգիս Հ․-ին մեղադրանք է առաջադրվել Քրեական օրենսգրքի 195-րդ հոդված 1-ին մասի հատկանիշներով։ Այն է՝ հարվածներ հասցնելը կամ բռնի այլ գործողություններ կատարելը, եթե չեն առաջացել սույն օրենսգրքի 171-րդ հոդվածով նախատեսված հետևանքները` պատժվում է տուգանքով` առավելագույնը քսանապատիկի չափով, կամ հանրային աշխատանքներով` ութսունից հարյուր հիսուն ժամ տևողությամբ, կամ ազատության սահմանափակմամբ` առավելագույնը մեկ տարի ժամկետով, կամ կարճաժամկետ ազատազրկմամբ՝ առավելագույնը մեկ ամիս ժամկետով:

Հոգևորականը ցուցմունքում նշել է, որ ինքը ոչինչ չի նկարել։ Նա ցուցմունքի վերջում հավելել է, որ ինքը որևիցե պահանջ չունի Սարգիս․ Հ-ից, ներել է նրան, հաշտվել է նրա հետ։

Օգոստոսի 6-ին հրապարակվել է դատարանի վճիռը, ըստ որի՝ մեղադրյալը ճանաչվել է մեղավոր ՀՀ քրեական օրենսգրքի 195-րդ հոդվածի 1-ին մասով նախատեսված հանցագործության կատարման համար։

«Դատապարտել տուգանքի՝ նվազագույն աշխատավարձի հնգապատիկի՝ 375.000 (երեք հարյուր յոթանասունհինգ հազար) ՀՀ դրամ գումարի չափով՝ տուգանքի վճարման համար սահմանելով մեկ ամիս ժամկետ։

2. Մեղադրյալի նկատմամբ ընտրված խափանման միջոց՝ բացակայելու արգելքը, թողնել անփոփոխ՝ մինչև դատավճռի օրինական ուժի մեջ մտնելը:

3. Դատավճիռը կարող է բողոքարկվել Վերաքննիչ քրեական դատարան` ստանալու օրվանից հետո՝ մեկամսյա ժամկետում»,-նշված է դատավճռում։
