«Փաստ» օրաթերթը գրում է.
Ինչպես տեղեկացրել էինք, գործարար Կարեն Հակոբյանը 2024 թվականի սեպտեմբերի 20-ից գտնվում է անազատության մեջ, իսկ նման ինտենսիվ և, ինչպես փաստաբաններն են նշում, խիստ անհամաչափ որոշման համար հիմքերը այդպես էլ մնում են անհասկանալի: Հակոբյանի փաստաբանական թիմից մեզ տեղեկացրին, որ Հակակոռուպցիոն դատարանի դատավոր Սարգիս Դադոյանի որոշումը բողոքարկվել է վերաքննության կարգով՝ հստակ հիմքերի և հիմնավորումների ներկայացմամբ:
Ի դեպ, ուշագրավ է, որ նշված քրեական վարույթը փաստացի սկիզբ է առել դեռևս 2019 թվականից, քրեական վարույթի վերաբերյալ առկա են բազմաթիվ հրապարակումներ: Եվ այսքան տարի անց դատարանի որոշումը ուսումնասիրելու դեպքում կարող է տպավորություն առաջանալ, թե քրեական վարույթը նոր է հարուցվել, այլ ոչ հինգ տարի առաջ, կամ Կարեն Հակոբյանին երբևէ նախկինում չեն հարցաքննել և նոր պետք է հարցաքննեին: Բազմաթիվ իրավաբաններ պարբերաբար շեշտում են, որ կալանքը որպես խափանման միջոց չպետք է չարաշահվի, այն պետք է իսկապես կիրառվի բացառիկ դեպքերում: Սակայն շատ հաճախ այս իշխանությունների օրոք կալանքը վերածվում է պատժի միջոցի:
Այս դեպքում ևս փաստաբանական թիմը միջնորդել էր նաև տնային կալանքը որպես խափանման միջոց ընտրել, որքան էլ որ միջնորդությամբ հիմնավոր կասկածի շեմը չէր հաղթահարվում, սակայն դատարանը գտել էր, որ հինգ տարվա վաղեմություն ունեցող գործով հինգ տարի անց միայն կալանքը պետք է ընտրվի որպես խափանման միջոց: Ընդհանրապես, փաստաբանները նշում են, որ Հակակոռուպցիոն դատարանը ամբողջովին անտեսել է փաստացի կալանքը բացառող ակնհայտ հանգամանքները:
