Արդյո՞ք աշխատանքային ժամից հետո գործատուն իրավունք ունի կապ հաստատել աշխատողի հետ․ հարցի իրավական կողմը

Աշխատանքային օրենսգրքով սահմանվում է, որ աշխատաժամանակի նորմալ տևողությունը չի կարող անցնել շաբաթական 40 ժամից և ամենօրյա աշխատաժամանակի տևողությունը չի կարող անցնել ութ աշխատանքային ժամից՝ բացառությամբ այս օրենսգրքով, օրենքով և այլ նորմատիվ իրավական ակտերով նախատեսված դեպքերի:
Միաժամանակ նշվում է, որ աշխատաժամանակի առավելագույն տևողությունը, ներառյալ` արտաժամյա աշխատանքը, չի կարող անցնել օրական 12 ժամից (հանգստի և սնվելու համար` ընդմիջումը ներառյալ), իսկ շաբաթվա ընթացքում` 48 ժամից:
Օրենսդրությամբ սահմանված իրավակարգավորումները հաճախ խախտվում են, լինում են դեպքեր, երբ աշխատողը սահմանված տևողությունից ավել է աշխատում՝ իր գործատուի նախաձեռնությամբ։
Հարցի վերաբերյալ փաստաբան Մարատ Ատովմյանն Iravaban.net-ի հետ զրույցում ասաց, որ օրվա ընթացքում սահմանվում է 8 ժամը, դրանից հետո աշխատողները կարող են շարունակել աշխատել, սակայն դրա համար ևս առանձին որոշումներ են կայացվում։
«Պրակտիկայում շատ դժվար է լինում հատկորոշել՝ իսկապես դա արտաժամյա աշխատանք է, թե ոչ, ոմ նախաձեռնությամբ է այդ աշխատանքն իրականացվել, քանի որ շատ հաճախ լինում է, երբ աշխատողն է իր նախաձեռնությամբ մնում, ինքն աշխատանք ունի կատարելու, ժամկետի հետ կապված խնդիր կա, աշխատանքից հետո մնում է ու այն կատարում իր ցանկությամբ»,-նշում է Մարատ Ատովմյանը։
Որոշ երկրներում փորձում են այս հարցի վերաբերյալ օրենսդրական լուծումներ տալ, ընդուպ սահմանափակել այդ երևույթը՝ արդյո՞ք աշխատանքային ժամից հետո գործատուն իրավունք ունի կապ հաստատել աշխատողի հետ և գործնական ինչ-որ բան ճշտել, հանձնարարություն տալ, թե՞ պետք է սպասի աշխատանքային օրվան։
«Մի քանի օր առաջ եմ վերադարձել Ստրասբուրգից, այս հարցերը քննարկվել են հենց Եվրոպայի խորհրդում, և իրենք ասում են, որ հաճախ ստիպված են լինում աշխատել աշխատանքային ժամից հետո, որովհետև, օրինակ, պետք է կազմակերպեն ինչ-որ կոնֆերանս, պետք է գան տասնյակ մասնակիցներ, զբաղվեն բազմաթիվ կազմակերպչական հարցերով։ Բնականաբար, աշխատողը իր բարեխղճությունից ելնելով, չի կարող ասել՝ արդեն ժամը 6-ն է, ես պետք է գնամ տուն»,-ասաց փաստաբանը։
