Միջազգային դատարանում արցախցիների իրավունքների խախտման վերաբերյալ մի մեծ փաթեթ է ներկայացվել

Արցախի ինքնապաշտպանական ուժերի նախկին գլխավոր հրամանատար, պաշտպանության նախարար, ռազմական և քաղաքական գործիչ Սամվել Բաբայանը վերջերս տված իր հարցազրույցներում պարբերաբար անդրադառնում է միջազգային դատարաններ դիմելու՝ արցախցիների իրավունքները վերակագնելու հարցերին։
MediaHub-ը զրուցեց Արցախի Մարդու իրավունքների պաշտպան Գեղամ Ստեփանյանի հետ, պարզելու, թե այս մասով ի՞նչ գործեր կան միջազգային դատարաններում, ի՞նչ պետք է արվի, որ ՄԻՊ ինստիտուտը չի անում։
«Արցախի ժողովրդի իրավունքների պաշտպանության վերաբերյալ այս պահին Եվրոպական դատարանում կան հարուցված գործեր։ Հարուցված 4 գործերից 3-ը վերաբերվում է արցախահայության իրավունքներին, որից վերջինը վերաբերում է շրջափակման, պատերազմի ու բռնագաղթի ընթացքում տեղի ունեցած մարդու իրավունքների խախտումներին։ Հասցեագրվել է նաև արցախահայության կորցրած գույքը, ինչպես նաև պատմամշակութային ժառանգության հարցը»,-նշեց Ստեփանյանը։
Ըստ ՄԻ պաշտպանի, սա կատարված աշխատանքի մի մեծ փաթեթ է, որը նեռառում է արցախահայության անհատական իրավունքները։
«Կա մի նրբություն, որ պետք է հաշվի առնել։ Միջազգային եվրոպական դատարանի մասնագետները պնդում են, որ անհատական գանգատներ տանելու դեպքում դատարանը դրանք միացնում է միջպետական գանգատին։ Այսինքն, որպես կանոն՝ արցախահայերի կոնկրետ գույքային իրավունքների պաշտպանության հարցը կդիտարկվի մեկ ամբողջության մեջ։ Այսպես, թե այնպես դատարանը դրանք դիտարկելու է մեկ ամբողջության մեջ և որոշումներն էլ կայացվելու են ընդհանրական»։
Ստեփանյանը նաև չբացառեց այն հնարավորությունը, որ կլինեն անձինք, ովքեր կնախընտրեն անհատական գանգատներ տանելու։ Սակայն, ոլորտում մասնագիտացված իրավաբանները վստահեցրել են, որ անհատական գանգատների անհրաժեշտություն չկա։
