2024թ. սեպտեմբերի 24-ին Երևան քաղաքի բնակչուհին հաղորդում է տվել այն մասին, որ ժամը 01։00-ի սահմաններում տեսել է, որ իր բնակության վայր հանդիսացող Երևան քաղաքի Կոմիտասի պողոտա 46 հասցեի բակային հատվածում կայանված իրեն պատկանող «Honda Kona» մակնիշի և հարևանությամբ կայանված «Opel» և «BMW» մակնիշի ավտոմեքենաներն այրվում են:

Հաղորդման առթիվ ՀՀ քննչական կոմիտեի ԵՔՔՎ Արաբկիր վարչական շրջանի քննչական բաժնում, ՀՀ քրեական օրենսգրքի 264-րդ հոդվածի 2-րդ մասի 2-րդ և 6-րդ կետերի հատկանիշներով, նախաձեռնվել է քրեական վարույթ, որի շրջանակներում վնասված ավտոմեքենաների սեփականատերերը տուժող են ճանաչվել և հարցաքննվել։

Նախաքննության ընթացքում զննության են ենթարկվել դեպքի վայր հանդիսացող ավտոկայանատեղին և այրված ավտոմեքենաները, առգրավվել են դեպքի վայրի հարակից տարածքում տեղադրված տեսանկարահանող սարքերի տեսագրությունները, ենթարկվել զննության։

Քրեական վարույթով էական նշանակություն ունեցող հանգամանքներ պարզելու նպատակով նշանակվել է դատահրդեհատեխնիկական, դատահետքաբանական և դատաապրանքագիտական համալիր փորձաքննություն։

Ձեռնարկված ապացուցողական և վարութային անհետաձգելի գործողությունների արդյունքում պարզվել է ենթադրյալ հանցագործություն կատարած անձի ինքնությունը, ով 23-ամյա երիտասարդ է:

Վերջինս ՀՀ ՆԳՆ ոստիկանության Արաբկիրի բաժնի աշխատակիցների կողմից ներկայացվել է վարույթն իրականացնող մարմնին, ձերբակալվել է և հարցաքննվել դեպքի հանգամանքների շուրջ` հայտնելով, որ արարքը կատարել է սոցիալական ցանցում այլ անձանց հետ հաղորդակցությունից ստացած տպավորությունների ազդեցությամբ:

Քննությամբ պարզվել է, որ դեպքի օրը՝ 2024 թվականի սեպտեմբերի 24-ին՝ ժամը 00:45-ի սահմաններում, երիտասարդն իր հետ նախապես վերցրած բենզինը լցրել է «Honda Kona» մակնիշի ավտոմեքենայի վրա և հրկիզել այն, որի հետևանքով այդտեղ կայանված այլ անձանց պատկանող «Opel» և «BMW X6» մեքենաները նույնպես այրվել են՝ ավտոմեքենաների սեփականատերերին պատճառելով առանձնապես խոշոր չափերի գույքային վնաս:

Ձեռք բերված բավարար փաստերի հիման վրա՝ երիտասարդին մեղադրանք է ներկայացվել՝ ՀՀ քրեական օրենսգրքի 264-րդ հոդվածի 2-րդ մասի 2-րդ, 4-րդ և 6-րդ կետերով։

Միջնորդություն է ներկայացվել դատարան՝ նրա նկատմամբ կալանքը որպես խափանման միջոց կիրառելու վերաբերյալ, որը բավարարվել է։

Նախաքննությունը շարունակվում է: Ձեռնարկվում են միջոցառումներ՝ հրկիզմանն այլ անձանց հնարավոր առնչությունը պարզելու ուղղությամբ:

Ծանուցում. Հանցանքի համար մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով դատարանի` օրինական ուժի մեջ մտած դատավճռով:
