Սպասումներ կան COP29-ից․ հնարավոր է, որ Բաքուն գերիներ ազատ արձակի․ Սիրանուշ Սահակյան

Կան շարունակաբար տարվող աշխատանքներ գերիների ազատ արձակման ուղղությամբ, ցավոք դրանք արդյւոնք չեն տվել, ինչը եւս մեկ վկայություն է, թե որքան ցանկալի են Ադրբեջանի իշխանությունների համար Արցախի ռազմաքաղաքական ղեկավարության ներկայացուցիչները: Այս մասին NEWS.am-ի հետ զրույցում ասաց Մարդու իրավունքների եվրոպական դատարանում ռազմագերիների ներկայացուցիչ, Միջազգային և համեմատական իրավունքի կենտրոնի նախագահ Սիրանուշ Սահակյանը։
«Արցախի ինքնորոշման իրավունքի կործանումը եղել եւ շարունակում է մնալ Ադրբեջանի քաղաքականության շրջանակում: Կան, իհարկե, գործընթացներ, որի շրջանակում կարող ենք սպասումներ ձեւավորել, որ այս անձինք կարող ենա զատ արջակվել: Կան մեծ սպասումներ COP29-ի համատեքստում, որն ունի մարդու իրավունքների առանցքային բաղադրիչ: Իրատեսական մոտեցման պարագայում մենք կանխատեսում չունենք ղեկավարության ազատ արձակում, սակայն չենք բացառում այլ կատեգորիայի պատանդների ազատ արձակում: Օրինակ, 2023-ի պատերազմի ռազմագերիները, որոնք կարող են մարդասիրական ժեստի ֆոնին ազատ արձակվել:
Զուգահեռաբար աշխատանքներ են տարվում իրավական համակարգում, կա գործերից որոշներում ակտիվ կոմունիկացիա ՄԻԵԴ-ի միջոցով Ադրբեջանի կառավարության հետ, սակայն դրանք եւս եզրափակված գործընթացներ չեն: Ուստի պետք է դեռ սպասել»,-ասաց նա:
Սահակյանի խոսքով, աշխատանքի ուղղությունը այս ժամանակահատվածում պետք է լինի դիվանագիտական քաղաքականը: Դրան միտված քայլերից մեկը նաեւ Մարդու իրավունքների խորհրդի այս նստաշրջանում խնդիրը բարձրաձայնելն է:
Ինչ վերաբերում է Բաքվում Արցախի ռազմաքաղաքական ղեկավարության դատավարությանը, Սիրանուշ Սահակյանն ասաց, որ որեւէ արդարացնող դատական ակտ Ադրբեջանի ներկա պատմության մեջ չի կայացվել եւ չի կարող կայացվել հայերի նկատմամբ. «Անկախ այդ գործերի փաստական հիմնավորվածությունից Ադրբեջանի դատարանները քաղաքական պատվերի հիման վրա վավերացնում են դատախազության ներկայացրած մեղադրանքները: ԴՐանք ձեւված, կարված են քաղաքական պատվերի շրջանակում: Մենք տեսնում ենք, որ բանավոր կերպով քաղաքական պատվեր է տրվում նախագահի, ԱԳ նախարարի մակարդակով, որին հաջորդում է իրավապահ համակարգի հայտարարությունը, որ նրանք բացահայտել են հանցագործություններ՝ կապված հայերի կողմից տարաբնույթ հանցագործությունների հետ: Սա ցույց է տալիս, որ ձեւավորվում է այդ քաղաքական պատվերը եւ իրավապահ համակարգը սպասարկում է: Նման սպասարկող ֆունկցիա Ադրբեջանում իրականացնում են դատարանները: Բոլոր միջազգային գնահատումները՝ անկախ կառույցների կողմից բարձրաձայնում են հեռախոսային արդարադատությունը, քաղաքական պատվերով դատական ակտերի կայացումը: Ադրբեջանը քաղբանտարկյալների թվով աշխարհում առաջատարների շարքում է»,- հայտարարեց Սահակյանը:
Նա ընդգծեց, որ մեր պայքարի իրկան հարթակը միջազգային ատյաններն են. «Կան միջպետական եւ անհատական գանգատներ ՄԻԵԴ-ում: Բոլոր այն գործերը, որոնք միջպետական գանգատի շրջանակներում են ներկայացվել, դրանք անհատական գործընթացներով բարձրաձայնվել են ՄԱԿ-ի մարդու իրավունքների հարցերով զբաղվող մեխանիզմներում»:
