ՀՀ հակակոռուպցիոն կոմիտեում քննված քրեական վարույթով կատարված նախաքննությամբ հիմնավորվել է, որ Երևանում շինարարական գործունեությամբ զբաղվող ընկերություններից մեկի տնօրեն Ա. Տ.-ն հիշյալ ընկերությանը պատկանող հողատարածքում կառուցապատման աշխատանքների իրականացման ընթացքում քաղաքաշինական հնարավոր խոչընդոտներից խուսափելու նպատակով պաշտոնատար անձանց փորձել է տալ 80 մլն դրամ կաշառք: Այս մասին հայտնում են Հակակոռուպցիոն կոմիտեից:
Մասնավորապես՝ նախաքննությամբ պարզվել է, որ Ա. Տ.-ն, բազմաբնակարան շենքի կառուցապատման համար տրված շինթույլտվության ժամկետը երկարաձգելու համար Երևանի քաղաքապետարանի պաշտոնատար անձանց կաշառք տալու նպատակով իր ծանոթ Գ. Գ.-ի միջոցով դիմել է Թ. Ա.-ին: Վերջինս, սակայն, նպատակ չունենալով հիշյալ հարցով դիմել որևէ պաշտոնատար անձի, կաշառքի միջնորդության պատրվակով դրամական միջոց ստանալու դիտավորությամբ, Գ. Գ.-ին վստահեցրել է, թե իբր Երևանի քաղաքապետարանի իրավասու պաշտոնատար անձանց շրջանում ունի ծանոթներ, որոնք 80 մլն ՀՀ դրամ կաշառքի դիմաց կարող են կազմակերպել վերը նշված հողատարածքում կառուցապատման հնարավոր խոչընդոտները վերացնելու հարցը:
Ընդունելով պաշտոնատար անձանց կաշառք տալու առաջարկը՝ Ա. Տ.-ն Գ. Գ.-ին է փոխանցել պահանջված գումարի մի մասը՝ 40 մլն ՀՀ դրամը, որից 25 մլն ՀՀ դրամը, նախապես ձեռք բերված պայմանավորվածության համաձայն, Գ. Գ.-ն 2022 թվականի դեկտեմբերի 6-ին փոխանցել է Թ. Ա.-ին: Վերջինս, սակայն, ստանալով նշված գումարը, այն որևէ պաշտոնատար անձի չի փոխանցել: Այսինքն՝ Ա. Տ.-ի կողմից պաշտոնատար անձանց առանձնապես խոշոր չափերով կաշառք տալը, նրա կամքից անկախ հանգամանքներով չի իրագործվել:
Վերը նշված հանցավոր արարքների կատարման համար Ա. Տ.-ին մեղադրանք է ներկայացվել ՀՀ քրեական օրենսգրքի 46-436-րդ հոդվածի 2-րդ մասի 3-րդ կետով, իսկ Գ. Գ.-ին՝ 44-46-436-րդ հոդվածի 2-րդ մասի 3-րդ կետով:
Հիշյալ երկու մեղադրյալների վերաբերյալ քրեական վարույթով նախաքննությունն ավարտվել է, և վարույթի նյութերը մեղադրական եզրակացությամբ ուղարկվել են դատարան՝ ըստ էության քննելու համար:
Թ. Ա.-ի նկատմամբ հարուցվել է հանրային քրեական հետապնդում ՀՀ քրեական օրենսգրքի 440-րդ հոդվածի 2-րդ մասով: Նրա նկատմամբ որպես խափանման միջոց է ընտրվել կալանքը և հայտարարվել հետախուզում:
Ծանուցում. հանցագործության համար մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
