ԱԺ-Կառավարությու հարցուպատասխանի ժամանակ ՀՀ վարչապետ Նիկոլ Փաշինյանը անդրադարձավ Հայաստանի առաջարկած տրամաբանությանը, որը վերաբերում է Ադրբեջանի և Հայաստանի սահմանադրություններին:

«Սահմանադրությանը հակասող միջազգային պայմանագրերը չեն կարող վավերացվել։ Ենթադրենք՝ ստորագրեցինք Խաղաղության պայմանագիրը, որ Հայաստանը Ադրբեջանից, Ադրբեջանը Հայաստանից տարածքային պահանջներ չունի, ճանաչում է նրա տարածքային ամբողջականությունը և պարտավորվում է ապագայում որևէ տարածքային պահանջ չներկայացնել։ Այդ հարցը գնում է Սահմանադրական դատարան: Եթե որոշվում է, որ այդ դրույթը մեր Սահմանադրությանը չի համապատասխանում, որովհետև մեր Սահմանադրության մեջ դրույթ կա, որ տենց չէ, արձանագրվում է, որ մենք ունենք տարածքային պահանջներ Ադրբեջանից, մենք ասում ենք՝ ժողովուրդ, սենց վիճակ է, պետք է դիրքավորվենք այս իրավիճակի նկատմամբ։

Եթե Սահմանադրական դատարանը ասում է, որ համապատասխանում է Սահմանադրությանը և ուղարկում է ԱԺ, վավերացվում է այն դրույթը, որ ՀՀ-ն չունի տարածքային պահանջներ Ադրբեջանի նկատմամբ, ստանում է բարձրագույն իրավական ուժ։ Իսկ երբ որ այդ պայմանագիրը վավերացվում է՝ ՀՀ գործող Սահմանադրության հինգերորդ կետի համաձայն, բոլոր այն օրենքները, որը հակասում են վավերացված միջազգային պայմանագրին, ուրեմն գերակայում է վավերացված միջազգային պայմանագրին»,- պարզաբանեց վարչապետը։

Նրա խոսքով՝ ակնհայտ է, որ Ադրբեջանի Սահմանադրությունը պարունակում է տարածքային պահանջներ ՀՀ-ի նկատմամբ, բայց Խաղաղության պայմանագրի նշված ընթացակարգը տեղի է ունենալու նաև ադրբեջանական կողմի մոտ։
