Եվրամիության բարձրագույն դատական ատյանը՝ ԵՄ արդարադատության դատարանը, սեպտեմբերի 10-ին վճռել է, որ տեխնոլոգիական ոլորտի «հսկա» ամերիկյան Apple ընկերությունը պետք է վճարի 13 միլիարդ եվրոյի հարկեր, որոնք չի վճարել Իռլանդիայի իշխանությունների հետ անօրինական համաձայնագրի արդյունքում:
Այսպիսով, ԵՄ բարձրագույն դատարանը բեկանել է ստորին ատյանի դատարանի որոշումը, որը բխում էր ամերիկյան ընկերության շահերից, գրում է kommersant.ru-ն։
Եվրոպական դատարանի որոշումը վերաբերում է մի գործի, որը սկսվել է դեռևս 2016թ.: Այն ժամանակ Եվրահանձնաժողովն անօրինական էր ճանաչել Իռլանդիայի իշխանությունների կողմից Apple-ին հարկային արտոնություններ տրամադրելու որոշումը: Եվրահանձնաժողովը որոշել էր, որ Apple-ը պետք է ամբողջովին վերադարձնի չվճարված հարկերը՝ 13 միլիարդ եվրո:
Ամերիկյան ընկերությունը վիճարկել է այս որոշումը, և 2020 թվականին դատարանն անցել է Аpple-ի կողմը։ Հենց այս որոշումն է այժմ բեկանվել։
Եվրոպական դատարանի կարծիքով՝ Եվրահանձնաժողովն իրավացի է համարել, որ հարկային պայմանավորվածություններն Իռլանդիայի հետ, որոնք, օրինակ, թույլ են տվել հարկերը հաշվարկելիս հաշվի չառնել Apple-ի միջազգային և եվրոպական ստորաբաժանումներին պատկանող մտավոր սեփականության օգտագործման լիցենզիաներից ստացված եկամուտները, իրականում Իռլանդիայի կառավարության կողմից աջակցությունէ Аpple-ին:
Փորձագետները նշում են, որ Եվրոպական դատարանի ներկայիս որոշմանը ուշադրությամբ հետևում են աշխարհի առաջատար տեխնոլոգիական ընկերությունները, որոնցից շատերը բարենպաստ հարկային համաձայնագրեր են կնքել առանձին եվրոպական երկրների հետ։ Անցյալ տարի ԱՄՆ մեկ այլ տեխնոլոգիական հսկա՝ Amazon-ը, Եվրոպական դատարանում հաղթանակ տարավ Լյուքսեմբուրգի հետ իր հարկային հարաբերությունների հարցում: Այն ժամանակ, սակայն, խոսքը շատ ավելի փոքր գումարի մասին էր՝ 25 մլն դոլար։
