Գորիսի քաղաքապետ Առուշ Առուշանյանը կազատազրկվի. հրապարակվել է ժամկետը

Սյունիքի մարզի ընդհանուր իրավասության դատարանը մասնակի բավարարեց Պրոբացիայի ծառայության միջնորդությունը՝ Գորիսի համայնքապետ Առուշ Առուշանյանի նկատմամբ ընտրված պատիժն ազատազրկմամբ փոխարինելու վերաբերյալ։
«Դատապարտյալ Առուշ Առուշանյանի նկատմամբ դատարանը 2022 թվականի մարտի 28-ի դատավճռով նշանակված պատիժը ՏԻՄ ղեկավար պաշտոն զբաղեցնելու իրավունքից 5 տարի ժամկետով զրկելը փոխարինեց 1 տարի 8 ամիս 3 օր ժամկետով ազատազրկման՝ ՏԻՄ ղեկավար պաշտոն զբաղեցնելու իրավունքից զրկելու 3 օրը հաշվարկելով ազատագրական մեկ օրի դիմաց»,- ասաց Սյունիքի մարզի ընդհանուր իրավասության դատարանի դատավոր Վարսենիկ Մելքոնյանը։
Դատարանի որոշումը կարող է բողոքարկվել։
Պրոբացիայի ծառայությունն ավելի վաղ դիմել էր Գորիս համայնքի ավագանուն՝ տեղեկացնելով, որ համայնքի ղեկավարը պետք է պաշտոնանկ արվի։ Ավագանու նիստի մասնակից 14 անդամները միաձայն արձանագրել էին, որ գրության պահանջն ավագանու գործառույթներից դուրս է, առկա է այդ գործընթացը ավագանու կողմից կազմակերպելու անհնարինության վիճակ։
Արդարադատության նախարարության Պրոբացիայի ծառայությունն ավելի վաղ միջնորդություն էր ներկայացրել դատարան՝ Գորիսի համայնքապետ Առուշ Առուշանյանի նկատմամբ նշանակված պատիժը՝ տեղական ինքնակառավարման մարմիններում ղեկավար պաշտոն զբաղեցնելու իրավունքից զրկելը, ազատազրկմամբ փոխարինելու, ինչպես նաև ազատազրկման ձևով պատիժը պայմանականորեն չկիրառելու վերաբերյալ որոշումը վերացնելու և պատիժը կրելու ուղարկելու վերաբերյալ:
Քրեական գործը, որի շրջանակներում մեղավոր է ճանաչվել Առուշանյանը, վերաբերում է «պաշտոնեական դիրքը չարաշահելուն, ինքնիրավչությանը, ինչպես նաև դիտավորությամբ այլ մարդու առողջությանը վնաս պատճառելուն»։
