Վաղը կբեկանվի՞ Ավետիք Չալաբյանի գործով առաջին ատյանի դատարանի որոշումը. «Փաստ»

«Փաստ» օրաթերթը գրում է.
Երեկ վերաքննիչ քրեական դատարանում տեղի ունեցավ «Հայաքվե» նախաձեռնող խմբի համակարգող, հասարակական-քաղաքական գործիչ Ավետիք Չալաբյանի գործով բերված վերաքննիչ բողոքի փաստացի եզրափակիչ քննությունը, որի ժամանակ Չալաբյանն ու իր փաստաբանական թիմը հանդես եկան ամփոփիչ ելույթներով՝ նշելով բոլոր այն խախտումները, որոնք թույլ են տրվել առաջին ատյանի դատարանում քննության ընթացքում, այդ թվում՝ կապված պետական մեղադրողի ներկայացրած ապացույցների, հիմնավորվածության, իրավաչափության և օրինականության, ինչպես նաև մեղադրանքի հիմքում ընկած փաստական բազայի սնանկության առումով: Պետական մեղադրողն ավելացնելու ոչինչ չուներ, պարզապես խնդրեց մերժել վերաքննիչ բողոքը և ուժի մեջ թողնել առաջին ատյանի դատավճիռը:
Վերաքննիչ դատարանը չհասցրեց ավարտել նիստը և հաջորդ, ինչպես նախագահող դատավորը նշեց, «կարճատև նիստը» նշանակվեց սեպտեմբերի 11-ին, որից հետո դատարանը կհրապարակի իր որոշումը: Դատաքննության ընթացքում շատ փաստաբաններ «Փաստի» հետ զրույցում նշում էին, որ այս դատական գործը պարզապես «ջուր» է: Երեկ ևս մի քանի իրավաբաններ ասացին, որ վերաքննիչ դատարանն, ամենայն հավանականությամբ, կբավարարի Չալաբյանի և նրա փաստաբանական թիմի վերաքննիչ բողոքը, քանի որ, ըստ էության, առաջին ատյանի դատարանը ակնհայտ սխալ որոշում է կայացրել: Երեկվա դատական նիստից հետո թե՛ Ավետիք Չալաբյանը, թե՛ նրա փաստաբանները նույնպես նշում էին, որ վերաքննիչ դատարանից ակնկալիքները շատ մեծ են, որ կընդունվի օբյեկտիվ, օրինական որոշում:
«Վճռաբեկ բողոքի քննության ընթացքը, իմ գնահատմամբ, անհամեմատ առավել օբյեկտիվ, բաց, ներառական և կոնստրուկտիվ միջավայրում է անցնում, քան առաջին ատյանի դատարանում դատաքննությունը»,-ասաց Չալաբյանը՝ հավելելով, որ ակնկալիքներն այս դատարանից առավել բարենպաստ են, սակայն չի ցանկանում կանխատեսումներ անել:
