«Փաստ» օրաթերթը գրում է.
Էկոնոմիկայի նախարարությունն առաջարկում է փոփոխություններ և լրացում կատարել «Արտոնագրերի մասին» օրենքում: Նախագծով առաջարկվում է կառավարությանն իրավունք վերապահել արտակարգ իրավիճակներում կամ ծայրահեղ անհրաժեշտության այլ հանգամանքներում ազգային անվտանգության, սննդի, առողջապահության (ներառյալ՝ բժշկական ապրանքների հասանելիության և մատչելիության բացակայությունը) կամ կենսական այլ անհրաժեշտության ապահովմամբ պայմանավորված, երբ դա պահանջում է հասարակության շահը, թույլատրել առանց արտոնագրատիրոջ համաձայնության գյուտի օգտագործումը՝ վերջինիս այդ մասին տեղեկացնելով ամենասեղմ ժամկետում և համաչափ փոխհատուցում վճարելով: Փոխհատուցման ենթակա գումարի չափը և վճարման կարգը որոշելու ընթացակարգը կհաստատի կառավարությունը:
Օրենքի նախագծի ընդունման արդյունքում հնարավոր կդառնա արտակարգ իրավիճակներում կամ ծայրահեղ անհրաժեշտության այլ հանգամանքներում, երբ իրավիճակը պահանջում է անհապաղ միջոցներ ձեռնարկել մարդկային կյանքեր փրկելու համար, ամենասեղմ ժամկետներում կայացնել որոշում՝ առանց արտոնագրատիրոջ համաձայնության, գյուտի օգտագործումը թույլատրելու վերաբերյալ: Սա նաև հնարավորություն կընձեռի դեղագործական արդյունաբերության ոլորտի տնտեսվարողներին արտադրելու մինչ այդ չարտադրված արտադրատեսակներ՝ ապահովելով ինքնաբավություն ոլորտում, ինչպես նաև ներմուծման կրճատում՝ ի հաշիվ տեղական արտադրության ավելացման։
Ըստ նախագծի հիմնավորման, առաջարկվող փոփոխությունը կարող է արդյունավետ օգտագործվել հասարակության առողջության պահպանման նպատակով՝ հակազդելով վարակիչ հիվանդությունների տարածմանը և արտակարգ իրավիճակներում հանդիսանալ դեղերի, բժշկական ապրանքների հասանելիության ու մատչելիության բացակայությունը լրացնելու, ներմուծումը կրճատելու, արտադրության ծավալներն ավելացնելու օպտիմալ ճանապարհ: Նախարարությունն ընդգծում է՝ արտակարգ իրավիճակները, ծայրահեղ անհրաժեշտության այլ հանգամանքները, ելնելով մարդկային կյանքեր փրկելու անհրաժեշտությունից, պահանջում են որոշումների անհապաղ ընդունում և անհրաժեշտ քայլերի շտապ ձեռնարկում:
Ուստի անհրաժեշտություն է առաջանում առանց արտոնագրատիրոջ համաձայնության գյուտի օգտագործման հնարավորություն սահմանել նաև կառավարության թույլտվությամբ, վերջինիս կողմից ընդունված որոշման հիման վրա։ Ստացվում է, որ թվարկված իրավիճակներում առանց արտոնագրատիրոջ համաձայնության գյուտի օգտագործումը թույլատրելու իրավասությունը վերապահվելու է կառավարությանը:
