«Փաստ» օրաթերթը գրում է.
Արդարադատության նախարարությունն առաջարկում է լրացումներ կատարել Աշխատանքային օրենսգրքում: Օրենսգրքի 108.2րդ հոդվածի 1-ին մասի համաձայն՝ աշխատողի, այդ թվում՝ հանրային ծառայության մեջ գտնվող անձի նկատմամբ կալանքը որպես խափանման միջոց կիրառելու պահից մինչև այն այլ խափանման միջոցով փոխելը կամ վերացնելը աշխատողի լիազորությունները համարվում են կասեցված: 108.2-րդ հոդվածի լրացման ժամանակահատվածում գործած և 2022 թ.-ի հուլիսի 1-ին ուժը կորցրած Քրեական դատավարության օրենսգրքի 134-րդ հոդվածի 2-րդ մասի համաձայն, խափանման միջոցներն են կալանավորումը, գրավը, ստորագրությունը՝ չհեռանալու մասին, անձնական երաշխավորությունը, կազմակերպության երաշխավորությունը, հսկողության հանձնելը, հրամանատարության հսկողության հանձնելը:
Քրեական դատավարության նոր օրենսգիրքը ուժի մեջ է մտել 2022 թ.-ի հուլիսի 1-ին: Օրենսգրքի 115-րդ հոդվածի 2-րդ մասը, ի թիվս այլնի, որպես այլընտրանքային խափանման միջոց դիտարկում է նաև տնային կալանքը: Աշխատանքային օրենսգրքով որպես աշխատողի լիազորությունների կասեցման հիմք նախատեսված է միայն կալանքը, և համանման փաստական հանգամանքներում անձի նկատմամբ որպես այլընտրանքային խափանման միջոց տնային կալանքը կիրառվելու դեպքում պարզ չէ, թե ինչ կարգավիճակ է ունենալու աշխատողը, արդյոք այդ դեպքում կարո՞ղ է շարունակել իր աշխատանքային պարտականությունների կատարումը, թե՞ ոչ:
Այսինքն, այս մասով աշխատանքային հարաբերությունների հետագա ընթացքին վերաբերող հարցերը մնում են օրենսդրորեն չկարգավորված: Քրեական դատավարության նոր օրենսգրքի տրամաբանությամբ անձի նկատմամբ կալանքի կիրառման դեպքում առաջացող իրավական հետևանքները, հետագա աշխատանքային հարաբերություններին առնչվող իրավական բոլոր առանձնահատկությունները, որպես կանոն, պետք է գործեն նաև տնային կալանքի դեպքում, ինչի մասին վկայում է նաև այն հանգամանքը, որ քննարկվող խափանման միջոցներն իրենց բնույթով գրեթե նույնն են, հիմնական տարբերությունը կալանքի տակ պահվելու վայրն է, մի դեպքում՝ քրեակատարողական հիմնարկ, մյուս դեպքում՝ բնակավայր:
Հենց սրանով պայմանավորված էլ նախարարությունը մշակել է այս նախագիծը, որպեսզի ապահովվի տնային կալանքի՝ որպես այլընտրանքային խափանման միջոցի ներառումը Աշխատանքային օրենսգրքի 108.2րդ հոդվածի կարգավորման շրջանակներում՝ սահմանելով անձի նկատմամբ տնային կալանքի կիրառման դեպքում ծագող իրավական հետևանքները, աշխատանքային հարաբերությունների հետագա ընթացքը:
