Կենսաթոշակային տարիքի հասած բազմաթիվ արցախցիներ բախվում են այն խնդրին, որ կենսաթոշակ նշանակելիս 1992-2014 թթ․ ընկած ժամանակահատվածի աշխատանքային ստաժը չի հաշվարկվում:

«Պատճառը համապատասխան բազաների բացակայությունն է, որոնցով հնարավոր կլիներ ապացուցել այդ անձանց սոցիալական վճարներ կատարած լինելու կամ աշխատավարձ ստանալու՝ օրենքով պարտադիր համարվող հանգամանքը։
Նույն խնդրին բախվում են այն անձինք, որոնք 35 տարվա աշխատանքային ստաժի հիմքով ցանկանում են կենսաթոշակային տարիքից մեկ տարի շուտ անցնել թոշակի, նրանց պարագայում կենսաթոշակի նշանակումը ուղղակի անհնար է դառնում։
Արցախում 2020 թվականի 44-օրա պատերազմից հետո ԱՀ Աշխատանքի և սոցիալական հարցերի նախարարության կազմում ստեղծվել էր հանձաժողով, որը լիազորված էր համապարփակ քննության վերցնել այս հարցը և անհրաժեշտ հիմքերի առկայության դեպքում, հաստատել բռնի տեղահանվածների աշխատանքային ստաժը։
Նմանատիպ հանձնաժողով ստեղծելու մասին իրավակարգավորում առկա է նաև «Պետական կոնսաթոշակների մասին» ՀՀ օրենքում, որի 32-րդ հոդվածի 5-րդ մասը սահմանում է․«Պատերազմների, ռազմական գործողությունների, տարերային աղետների, վթարների, արհավիրքների և այլ արտակարգ իրավիճակների հետևանքով աշխատանքային ստաժը հաստատող փաստաթղթերի ձեռքբերման անհնարինության դեպքում Հայաստանի Հանրապետության կառավարությունն ստեղծում է աշխատանքային ստաժ սահմանող հանձնաժողովներ, որոնց կազմում ընդգրկվում են գործադիր իշխանության, գործատուների, արհմիությունների կամ աշխատողների լիազորած ներկայացուցիչներ»։
Սակայն նման հանձնաժողով ՀՀ կառավարության կողմից մինչ այսօր չի ստեղծվել։
Քանի դեռ խնդիրը կարգավորված չէ, միակ լուծումը շարունակում է մնալ դատական ճանապարհով աշխատանքային ստաժը հաստատելը, որը և ծախսատար է, և ժամանակատար։ Լավագույն դեպքում մի քանի ամիս է պահանջվում դատական այդ գործընթացով անցնելու համար։ Ինչ վերաբերում է դատարան դիմելու համար անհրաժեշտ իրավաբանական օգնությանը, ապա կան կազմակերպություններ, որոնք պատրաստակամ են անվճար ցուցաբերել այդ աջակցությունը։
Այնուամենայնիվ, պետք է ընդգծել, որ խնդիրը միանշանակ համակարգային լուծում է պահանջում, որովհետև այն մեկ կամ մի քանի հոգու վերաբերյալ չէ, այլ առնչվում է հազարավոր արցախցիների և առաջանալու է անընդհատ»,- գրել է Ստեփանյանը։
