Նախատեսվում է բարձրացնել քաղաքացիություն ստանալու և քաղաքացիությունը դադարեցնելու համար նախատեսված պետտուրքը. «Փաստ»

«Փաստ» օրաթերթը գրում է.

Ներքին գործերի նախարարությունն առաջարկում է փոփոխություններ և լրացումներ կատարել «ՀՀ քաղաքացիության մասին» և «Պետական տուրքի մասին» օրենքներում: Ներկայացված նախագծերով առաջարկվում է սահմանել քաղաքացիություն ստանալու և քաղաքացիությունը դադարեցնելու համար դիմելու էլեկտրոնային ընթացակարգ։ Ընդ որում, հաշվի առնելով անվտանգային մի շարք հանգամանքների առկայությունը՝ անձի առաջնային նույնացման անհրաժեշտությունը, փաստաթղթերի անվտանգային հատկանիշների ստուգումը և այլն, փաստաթղթերն անձամբ ներկայացնելու դրույթը պահպանվում է, սակայն նախատեսվում է փաստաթղթերը նախապես էլեկտրոնային ներկայացնելու հնարավորություն: Իրավասու մարմինը ստուգելու է դրանց ամբողջականությունը, բացառելու դիմումատուի՝ ՀՀ քաղաքացի հանդիսանալու հանգամանքը, որից հետո նոր միայն դիմումատուն հնարավորություն է ստանալու հերթագրվել և փաստաթղթերը անձամբ ներկայացնել լիազոր մարմին կամ օտարերկրյա պետությունում գործող համապատասխան դեսպանություն կամ հյուպատոսական հիմնարկ։

Հնարավորություն է ընձեռվում նաև քաղաքացիություն հայցող կամ քաղաքացիությունը դադարեցնել ցանկացող անձի վերաբերյալ բոլոր տեսակի հարցումները համապատասխան այլ մարմիններին՝ ՊԵԿ, ՊՆ, ոստիկանություն, ԱԱԾ և այլն, իրականացնել նախապես՝ էլեկտրոնային եղանակով, ուստի դիմումատուն կկարողանա մինչև դիմումի հանձնելը տեղում տեսնել իր վերաբերյալ պարտավորությունների առկայությունը, մարել դրանք, նոր ներկայացնել փաստաթղթերը։ Բացի դա, օրենքով նախատեսվում է քաղաքացիության գործերով վարույթները կասեցնելու հնարավորություն, քանի որ հաճախ վարույթի ընթացքում փաստաթղթերի, դրանցում առկա գրառումների իսկությունը ստուգելու անհրաժեշտություն է առաջանում։ Գործող օրենքը սահմանում է՝ եթե ՀՀ քաղաքացիությունը դադարեցնելուց հետո 5 տարվա ընթացքում պարզվի, որ անձը ներկայացրել է կեղծ փաստաթղթեր կամ առկա են քաղաքացիությունից դուրս գալու մասին դիմումը մերժելու օրենքով նախատեսված հիմքեր, ապա լիազոր մարմինը նախաձեռնում է անձի՝ ՀՀ քաղաքացիությունը դադարեցնելու վերաբերյալ Նախագահի հրամանագիրն ուժը կորցրած ճանաչելու գործընթաց, որի մասին անձը ծանուցվում է օրենքով սահմանված կարգով:

Ներկայացվող օրինագծով նախատեսվում է հինգ տարի ժամկետը փոխարինել տասը տարի ժամկետով, քանի որ բազմաթիվ են դեպքերը, երբ կեղծ փաստաթղթեր ներկայացնելու փաստը պարզվում է անձնագրի փոխանակման ժամանակ և 5 տարվա վաղեմության ժամկետն անցած լինելու փաստով պայմանավորված անհնար է լինում քաղաքացիությունը դադարեցնելու գործընթաց սկսելը։ Առաջարկվում են այլ փոփոխություններ ևս: «Պետական տուրքի մասին» օրենքում առաջարկվող փոփոխություններով նախատեսվում է բարձրացնել քաղաքացիություն ստանալու և քաղաքացիությունը դադարեցնելու համար նախատեսված պետական տուրքը և սահմանել, համապատասխանաբար, 20000 և 50000 դրամ՝ 1000 և 25000 դրամի փոխարեն։
