Առանց էլէներգիայի և գազի պարտքեր չունենալու մասին տեղեկանքի Կադաստրում անշարժ գույքի պետական գրանցում չի կատարվի. «Փաստ»

«Փաստ» օրաթերթը գրում է.
Տարածքային կառավարման և ենթակառուցվածքների նախարարությունն առաջարկում է լրացում կատարել «Էներգետիկայի մասին» 2001 թ. մարտի 7-ի ՀՕ-148 օրենքում: Ըստ նախագծի հիմնավորման, մի շարք խնդիրներ են առաջանում, երբ էլէներգիայի և գազի մատակարարները պետք է կնքեն պայմանագիր նոր սպառողների հետ, մինչդեռ հները որոշակի ֆինանսական պարտավորություններ ունեն: Նոր սպառողի հետ էլեկտրական էներգիայի կամ բնական գազի մատակարարման պայմանագիրը կնքվում է այն ժամանակ, երբ տեղի է ունենում սեփականության կամ օգտագործման և տիրապետման իրավունքի փոխանցում, իսկ անշարժ գույքի դեպքում այդ փոխանցումը ենթակա է գրանցման Կադաստրի կոմիտեի կողմից։
Այս պարագայում առաջարկվում է, որպես պետական գրանցման նախապայման, սահմանել տվյալ անշարժ գույքի սպառման համակարգով սպառված էլեկտրական էներգիայի կամ բնական գազի դիմաց վճարային պարտավորություններ (այդ թվում նաև՝ տույժ, տուգանք) չունենալու վերաբերյալ տեղեկանքի ներկայացումը։ Տեղեկանքը տրամադրվում է մատակարարի կողմից, որն ուժի մեջ է 5 աշխատանքային օր: Անշարժ գույքի գրանցման համար պարտքի բացակայության տեղեկանքի ներկայացման համար բացառություն են սահմանվում այն դեպքերը, երբ օտարումը կատարվում է Հարկադիր կատարումն ապահովող ծառայության, սնանկության կառավարչի կամ գրավառուի կողմից: Այսպիսով՝ նոր բաժանորդի հետ էլեկտրական էներգիայի կամ բնական գազի մատակարարման պայմանագիրը կնքվում է նախորդ սպառողի կողմից սպառված էլեկտրական էներգիայի կամ բնական գազի դիմաց վճարային պարտավորությունները (այդ թվում նաև՝ տույժ, տուգանք) ամբողջությամբ կատարված լինելու դեպքում։
Նախագծով առաջարկվող փոփոխության կատարման պարագայում անշարժ գույքի ձեռք բերման գործընթացում վաճառողը նախապես ձեռնամուխ կլինի իր սպառած էլէներգիայի կամ բնական գազի դիմաց պատշաճ վճարումները կատարելուն՝ հաշվի առնելով այն, որ չկատարումը հետագայում կխոչընդոտի պետական գրանցմանը: Իր հերթին գնորդը նախապես կձեռնարկի միջոցներ՝ պարզելու նշված անշարժ գույքի վերաբերյալ առկա պարտավորությունները, որի արդյունքում կխուսափի հետագա խնդիրներից: Օրենսդրական փոփոխությունը ենթադրում է որոշ բացառություններ:
