Փաստաթղթերի կեղծմամբ, խարդախությամբ, առանձնապես խոշոր չափերով հափշտակություն է կատարվել․ ՔԿ

2024 թվականի մայիսի 22-ին ՀՀ ՆԳՆ ոստիկանության ՔՈԳՎ-ից ստացված հաղորդման առթիվ ՀՀ քննչական կոմիտեի ՀԿԳ քննության գլխավոր վարչության սեփականության դեմ ուղղված հանցագործությունների քննության վարչությունում նախաձեռնված քրեական վարույթի նախաքննությամբ փաստական տվյալներ են ստացվել այն մասին, որ Հ․Խ.-ն այլ անձի (անձանց) սեփականության իրավունքով պատկանող, առանձնապես խոշոր չափերով՝ 5.050.000 ՀՀ դրամ արժողության, «LADA NIVA NIVATRAVEL» մակնիշի, 2022 թվականի թողարկման թեթև մարդատար ավտոմեքենան խաբեությամբ հափշտակելու նախնական դիտավորությամբ, 2024 թվականի հունվարի 18-ին կազմված որոշման, ապա դրան հաջորդած գրավոր հայտարարության տեքստերում ներառել է իրականությանը չհամապատասխանող, գոյություն չունեցող տեղեկություններ՝ ուրիշի գույքն օտարելու իրավասություն ունենալու վերաբերյալ, ապա ավտոմեքենայի օտարման գործարք կատարելու իրավասություն ունեցող պետական մարմին է ներկայացրել առերևույթ կեղծ տվյալներ պարունակող այդ փաստաթղթերը։
Դրանից հետո՝ 2024թ․ հունվարի 23-ին, առանց օրինական հիմքի, հանդես գալով որպես պայմանագրի կողմ, կնքել է տրանսպորտային միջոցի նվիրատվության պայմանագիր, որի արդյունքում գույքն ապօրինի օտարել է իրեն փոխկապակցված անձին՝ իր պապին՝ այդ կերպ առերևույթ խաբեությամբ հափշտակելով 5.050.000 ՀՀ դրամ արժեցող վերոնշյալ ավտոմեքենան:
Նախաքննությունը ընթացքում նշված անձի բնակության հասցեում կատարված խուզարկությամբ, ի թիվս այլնի, հայտնաբերվել և վերցվել են վերոհիշյալ որոշման բնօրինակները, սակայն այլ թվագրմամբ, բովանդակության այլ ձևակերպմամբ, ինչպես նաև մեկ այլ՝ «UAZ HUNTER» մակնիշի ավտոմեքենա օտարելու վերաբերյալ որոշման նախագիծ:
Ձեռք բերված տվյալների հիման վրա Հ.Շ.-ին մեղադրանք է ներկայացվել՝ ՀՀ քրեական օրենսգրքի 255-րդ հոդվածի 3-րդ մասի 3-րդ կետով և 457-րդ հոդվածի 1-ին մասով:
Նախաքննությունը շարունակվում է։ Քննություն է կատարվում՝ ինչպես նշված, այնպես էլ՝ այլ գույքերի, այդ թվում՝ «UAZ HUNTER» մակնիշի ավտոմեքենայի հնարավոր օտարման հանգամանքները պարզելու ուղղությամբ:
