Փաստաբանները բողոքի ակցիաներ կիրականացնեն

Հարգելի փաստաբաններ`
Այսօր, 2024 թվականի մայիսի 17-ին ՀՀ ԱԺ տնտեսական հարցերի մշտական հանձնաժողովի նիստում հավանության արժանացավ «Հայաստանի Հանրապետության հարկային օրենսգրքում փոփոխություններ և լրացումներ կատարելու մասին» օրենքի նախագիծը, որի առնչությամբ ՀՀ փաստաբանների պալատը բազմիցս բարձրայնել է դրա խնդրահարույց լինելը.
Նախագծի ընդունման արդյուքում
– Շեշտակի կբարձրանա փաստաբանական ծառայությունների ինքնարժեքը, հետևաբար և գները.
– Կբացառվի անվճար իրավաբանական օգնության տրամադրման (pro bono) հնարավորությունը, քանի որ այն նույնպես ենթակա է լինելու հարկման.
– Անհամեմատ կավելանա Հանրային պաշտպանի գրասենյակի դիմողների քանակը, որն էլ իր հերթին ավելացնելու է պետության ֆինանսական պարտավորության բեռը.
– Էականորեն կնվազի քաղաքացիների իրավաբանական օգնություն ստանալու մատչելիությունը և դատական պաշտպանության իրավունքի իրացման հնարավորությունը:
Պետք է փաստել, որ ՀՀ փաստաբանների պալատը Նախագծի խնդրահարույց ասպեկտների մասով առարկությունները և դիտողությունները, ի թիվս այլ մարմինների ներկայացրել էր նաև ՀՀ ֆինանսների նախարարություն և ՀՀ ԱԺ պետաիրավական հանձնաժողովին:
Դիտարկումների փաթեթը ներկայացվել էր նաև ՀՀ ԱԺ նախագահին՝ խնդրելով Նախագիծը քննարկելիս հաշվի առնել ներկայացվածը և ՀՀ փաստաբանների պալատին մասնակից դարձնել տնտեսական հարցերով մշտական հանձնաժողովի նիստին:
Սակայն, ՀՀ փաստաբանների պալատը չհրավիրվեց Հանձնաժողովի նիստին, իսկ նիստի ընթացքում էլ հայտարարվեց, թե իբր Նախագծի առնչությամբ դիտարկումներ չեն ներկայացվել:
Հաշվի առնելով, որ Նախագիծը ԱԺ ներկայացվել է անհետաձգելի ընթացակարգով և սեղմ ժամկետում այն ներկայացվելու է Ազգային Ժողովի լիագումար նիստի քննարկմանը, ուստի նկատի ունենալով ս.թ. մայիսի 16-ին ակումբի նիստով ընդունված հայտարարության կենսագործման անհրաժեշտությունը՝
2024 թվականի մայիսի 21-ին ՀՀ փաստաբանները ձեռնամուխ կլինեն բողոքի ակցիայի իրականացմանը՝ հրաժարվելով Հայաստանի Հանրապետության պետական մարմիններում (այդ թվում՝ դատարաններում, նախաքննության մարմիններում) պաշտպանություն կամ ներկայացուցչություն իրականացնելուց՝ պահանջելով Ազգային ժողովից հանել փաստաբաններին վերաբերող խնդրահարույց իրավակարգավորումները:
