«Հայոց Ազգային հպարտության տրիբունալը» կդառնա աշխարհի երկրների համար նախադեպային իրավունքի մեխանիզմ․ Արշակ Կարապետյան

«Համահայկական ճակատ» կուսակցությունն ու շարժումը դեռ չեն հասցրել ամբողջությամբ ներկայացնել «Հայոց Ազգային հպարտության տրիբունալի» վերաբերյալ իրենց պատկերացումները, սակայն այն բավականին լուրջ իրարանցում է առաջացրել, առավել ևս, որ «Համահայկական ճակատը» օրերս առաջարկել էր ստեղծել տրիբունալի խորհուրդ՝ դրա կազմում ընդգրկելով բոլոր ընդդիմադիր քաղաքական, հասարակական, երիտասարդական և տեղական կազմակերպություններին։ Առաջարկել են նաև դրա կազմում ընդգրկել հայ ժողովրդի հարգանքն ու համակրանքը վայելող հայ առաքելական եկեղեցու սպասավոր Բագրատ արքեպիսկոպոս Գալստանյանին։

Փաստացի, եթե նախկինում համարվում էր, որ «Հայոց Ազգային հպարտության տրիբունալում» կարող են ընդգրկվել միայն մասնագետ իրավաբաններ, որոնք քննելու են գործող իշխանությունների հանցագործությունները սեփական ժողովրդի դեմ, ապա վերջին առաջարկով և, հատկապես Բագրատ Սրբազանի ներգրավման նախաձեռնությամբ, պարզ է դառնում, որ տրիբունալը շատ ավելի լայն հասկացություն է լինելու՝ ընդգրկելով հեղինակություն վայելող անձանց։

Անկախ ամեն ինչից գործընթացը, որ պետք է լինի իրավական իր մեջ նաև բարոյական, քաղաքական ու քաղաքակրթական շերտեր է պարունակում, ուստի գործող իշխանությունների վարած քաղաքականության դատապարտումը պետք է տեղի ունենա ոչ միայն իրավական մակարդակով, ինչն, իհարկե, նման դեպքերում առաջնային է, բայց ոչ միակ կարևորագույն պայմանը։

Փաշինյանական վարչախմբի գործողությունները պետք է դատապարտվեն բոլոր առումներով, այդ իշխանության պետությանն ու հայրենիքին հասցված բոլոր վնասները պետք է մանրամասն ուսումնասիրվեն, ներկայացվեն հայ հանրության դատին, որպեսզի ոչ միայն հայության, Հայաստանի քաղաքացիների, Սփյուռքի համար տրբունալի կայացրած որոշումները լինեն առաջնային և աներկբա, այլ նաև օրինակելի դառնան աշխարհի բազմաթիվ երկրների համար՝ նախադեպային իրավունքի բավականին լուրջ մեխանիզմ դառնալով։

«Համահայկական ճակատ» շարժման առաջնորդ, Պաշտպանության նախկին նախարար գեներալ-մայոր Արշակ Կարապետյանի «Հայոց Ազգային հպարտության տրիբունալ» ստեղծելու առաջարկը, փաստացի, ոչ միայն իրավական, այլ նաև բոլոր շերտերը պարունակող առաջարկ է, և հենց սա է այն հիմնական կռվանը, որից սարսափած են գործող վարչախմբի ներկայացուցիչները։

Փաշինյանական իշխանության բոլոր առաջատար դեմքերը, պատգամավորները, պաշտոնյաները, ինքը՝ այդ թիմի առաջնորդը, հստակ հասկանում են, որ իրենք պատմության մեջ մնալու են որպես դավաճաններ, բայց անհրաժեշտ է այդ արձանագրումն անել հենց այսօր՝ փաստերի ամբողջական ուսումնասիրությամբ՝ ցույց տալով, որ վարչախմբի գործողությունները եղել են ոչ թե միայն անգիտության և տգիտության հետևանք, այլ հստակ նպատակամղված, դրսից ուղորդվող դավաճանություն է եղել սեփական ժողովրդի շահերի դեմ, դա է իրական հնարավորությունը պատմության դատաստանին գամելու գործող վարչախմբին։
