Նիկոլ Փաշինյանը սովորություն ունի դատական համակարգում բարձր պաշտոնները տալ տխրահռչակ այն դատավորներին, որոնք անվերապահորեն կատարում են իր բոլոր ցանկությունները։ Բարձրագույն դատական խորհրդի անդամ է ընտրվել Արմեն Դանիելյանը, որը վերաքննիչ քրեական դատարանի դատավոր է։ Արմեն Դանիելյանը հայտնի է մի շարք աղմկահարույց գործերով, մասնավորապես՝ Դանիելյանը հայտնի է որպես Ռոբերտ Քոչարյանին կալանավորած դատավոր։

2019 թվականին դատավոր Դավիթ Գրիգորյանն ազատ էր արձակել երկրորդ նախագահին, իսկ վերաքննիչ դատարանում Արմեն Դանիելյանը բավարարել էր դատախազության բողոքը, և երկրորդ նախագահին կրկին կալանավորել էին։ Դանիելյանը հայտնի է ոչ միայն Քոչարյանի գործով, 2008 թվականի մարտի 1-ի դեպքերից հետո էլ նա անվերապահորեն կատարում էր օրվա իշխանությունների բոլոր հրահանգները՝ Տեր-Պետրոսյանի հանրահավաքի մի քանի մասնակիցների տևական ազատազրկման դատապարտելով։

2018 թվականի իշխանափոխությունից հետո հույս կար, որ Փաշինյանը, որն ինքն էլ մի քանի տարի անցկացրել էր անազատության մեջ, կմաքրի դատական համակարգը, կհեռացնի տխրահռչակ և ապօրինի որոշումներ կայացնող դատավորներին, այդ թվում՝ իրեն դատած դատավոր Մնացական Մարտիրոսյանին, փոխարենը՝ Փաշինյանը նախընտրեց օգտվել այդ դատավորների ծառայություններից և նրանց օգտագործել իր հակաօրինական նպատակների համար։
