«Փաստ» օրաթերթը գրում է.

Ֆինանսների նախարարությունն առաջարկում է լրացում կատարել Հարկային օրենսգրքում: Նախագծի նպատակը ոսկյա իրերի օտարման գործարքների՝ ԱԱՀ-ով հարկման բազայի որոշման կանոնների վերանայումն է՝ ոսկեգործության ոլորտի զարգացման համար նպաստավոր հարկային միջավայր ձևավորելու ակնկալիքով: Գործող Հարկային օրենսգրքի համաձայն, թանկարժեք մետաղների օտարումն ազատված է ավելացված արժեքի հարկից: Միաժամանակ, այդ նույն թանկարժեք մետաղներից պատրաստված իրերի «ոսկերչական զարդերի» օտարումը հարկվում է ԱԱՀ-ով, իսկ այդ գործարքների մասով ԱԱՀ-ով հարկման բազան հաշվարկվում է Հարկային օրենսգրքով սահմանված ընդհանուր կարգավորումների շրջանակներում:

Այս պարագայում ստացվում է, որ, անկախ այն հանգամանքից, որ ոսկու օտարումն ազատված է ԱԱՀից, ոսկյա զարդի մեջ առկա ոսկին արժեշղթայի հետագա օղակներում փաստացի հարկվում է ԱԱՀ-ով: Ընդ որում, հատկանշական է նաև այն, որ ոսկու արժեքը հաճախ կազմում է ոսկյա զարդերի արժեքի հիմնական մասը: Խնդիրը նաև այն է, որ ոսկին՝ որպես առանձնահատուկ ապրանք, յուրաքանչյուր անգամ արժեշղթայի օղակներով անցնելիս նորովի չի ստեղծվում որպես արժեք, այլ պարզապես մի ձևից վերափոխվում է մեկ այլ ձևի՝ իր արժեքը փոխանցելով արժեշղթայի հաջորդական օղակներով: Այլ կերպ ասած՝ ոսկու ձուլակտորից ոսկյա զարդ պատրաստելու օղակում ոսկու արժեքը չի համարվում նոր ստեղծված արժեք: Հետևաբար, այս պարագայում ոսկու՝ ԱԱՀ-ով հարկումը մի կողմից խնդրահարույց է, մյուս կողմից՝ հանգեցնում է ոսկյա զարդերի գների բարձրացման՝ դրանով իսկ խոչընդոտելով ոսկեգործության ոլորտի զարգացմանը: Նախագծով առաջարկվում է սահմանել, որ ոսկուց պատրաստված իրերի օտարման գործարքների մասով Հարկային օրենսգրքով սահմանված կարգով հաշվարկվող ԱԱՀ-ով հարկման բազան նվազեցվելու է տվյալ իրի արտադրության համար օգտագործված՝ ստանդարտացված ոսկու ձուլակտորի կամ դրա մի մասի ձեռք բերման գնի չափով:

Ընդ որում, այդ կարգով նվազեցնելուց հետո ԱԱՀ-ով հարկման բազան չի կարող Հարկային օրենսգրքով սահմանված ընդհանուր կարգով հաշվարկվող ԱԱՀ-ով հարկման բազայի 25 տոկոսից պակաս լինել: Նախագծի ընդունման արդյունքում ակնկալվում է ոսկեգործության ոլորտի զարգացման համար ձևավորել նպաստավոր հարկային միջավայր: Հարկաբյուջետային քաղաքականության հիմնական նպատակը պետական ֆինանսական համակարգի բարձր արդյունավետությունն է: Դրան հասնելու նպատակով կառավարությունը շարունակելու է հարկային քաղաքականության այնպիսի բարեփոխումները, որոնք նպաստելու են բիզնես միջավայրի մրցունակության բարձրացմանը: Կառավարության կողմից իրականացվող հարկային քաղաքականությունն ուղղված է լինելու տնտեսության ներդրումային գրավչության բարձրացմանն ու տնտեսական ակտիվության մակարդակի բարելավմանը՝ դրանով իսկ ստեղծելով կայուն նախադրյալներ արտահանման և երկարաժամկետ տնտեսական աճի, հանրային բարիքի վերաբաշխման և հարկաբյուջետային կայունության ամրապնդման համար:
