«Տեսալսողական մեդիայի մասին» օրենքի կիրառման ընթացքում ի հայտ է եկել որոշ կարգավորումներ վերանայելու անհրաժեշտություն. «Փաստ»

«Փաստ» օրաթերթը գրում է.
Բարձր տեխնոլոգիական արդյունաբերության նախարարությունն առաջարկում է փոփոխություններ և լրացումներ կատարել «Տեսալսողական մեդիայի մասին» օրենքում: Այս օրենքը Ազգային ժողովի կողմից ընդունվել է 2020 թ. հուլիսի 16-ին, սակայն նշվում է, որ կիրառման ընթացքում ի հայտ են եկել որոշ կարգավորումներ վերանայելու, ինչպես նաև նոր կարգավորումներ նախատեսելու անհրաժեշտություն: Միաժամանակ, հաշվի առնելով, որ օրենքով արգելված է տեսալսողական հաղորդումներում օրենսդրությամբ արգելված արարքների կոչեր տարածելը, ինչն իր հերթին հանգեցնում է հեռարձակողի հեղինակազորման կամ լիցենզիայի գործողության կասեցման, որի պայմաններում բացառված չէ տեսալսողական մեդիածառայություն մատուցող օպերատորի (մուլտիպլեքս օպերատորի, ցանցային օպերատորի) կողմից տվյալ տեսալսողական ծրագրի հեռարձակումը, հետևաբար վերջինս բացառելու անհրաժեշտությունից ելնելով, որպես զսպող մեխանիզմ՝ այս նախագծի միջոցով առաջարկվում է կատարել մի շարք փոփոխություններ:
Մասնավորաբար՝ վերանայվել է Կարգավորող մարմնին վերաբերող գործառույթը, որը վերաբերում է տեսալսողական հաղորդումների տեխնիկական չափանիշների համապատասխանության վերահսկմանը: Ավելացվել է նոր պահանջ՝ հանրային մուլտիպլեքսի սլոթի օգտագործման լիցենզավորման մրցույթին մասնակցելու հայտի ներկայացմանը, մասնավորապես՝ առաջարկվում է հայտին կցել նաև տեղեկանք՝ հեռարձակման ծառայությունների մասով ժամկետնանց պարտքեր և պարտավորություններ չունենալու մասին: Վերանայվել է հեղինակազորման և լիցենզիայի գործողության կասեցման և դադարեցման պայմանները, մասնավորապես առաջարկվող փոփոխությամբ հեղինակազորման և լիցենզիայի կասեցման պայման կարող է հանդիսանալ նաև համապատասխան ընդունված ստանդարտներին չհամապատասխանող տեխնիկական միջոցներով հեռարձակողի կամ օպերատորի գործունեությունը, որը կարող է տեխնիկական խոչընդոտներ ստեղծել Հայաստանում օրինական գործող ռադիոհաճախականություններ օգտագործող այլ սուբյեկտների գործունեության համար:
Նախագծով առաջարկվում է նաև համապատասխան իրավական հիմքեր ստեղծել՝ ցանցային օպերատորներին անվճար տարածման իրավունքով տրամադրված տեսալսողական ծրագրերը տարածելու պարտավորության պայմանների վերաբերյալ, քանի որ գործող օրենքում օպերատորների կողմից ծրագրերը տարածելու համար բացառություն նախատեսված չլինելու դեպքում, գործնականում հնարավոր է առաջանան այնպիսի հանգամանքներ, որոնք կարող են հանգեցնել օպերատորների՝ օրենքով նախատեսված պատասխանատվության՝ նկատի ունենալով նաև այն հանգամանքը, որ օրենքի 58-րդ հոդվածով նախատեսված դրույթները տարածվում են նաև ցանցային օպերատորների վրա այնքանով, որքանով կիրառելի են:
Նախագծով առաջարկվող կարգավորման արդյունքում գործնականում կբացառվեն տարընկալումները և կապահովվի իրավական որոշակիության սկզբունքը:
