Տիկին գլխավոր դատախազը շարունակում է դիտարկվել որպես քաղաքական իշխանության գլխավոր դատախազ, այլ ոչ թե ՀՀ-ի և հայ ժողովրդի շահերի ապահովմանն ուղղված լիազորություններով օժտված անկախ մարմնի ղեկավար։ Այս մասին Աժ-ում պետաիրավական հարցերով հանձնաժողովի նիստին իր ելույթի ժամանակ ասաց ԱԺ «Հայաստան» խմբակցության պատգամավոր Արծվիկ Մինասյանը։
«Դատախազի երդման մեջ պետք է բացառություն արվեր և գրվեր՝ բացառությամբ, եթե Նիկոլ Փաշինյանն այլ բան չի ասում։ Ինչո՞ւ եմ այս պնդումը կատարում, որովհետև ակնհայտ է՝ երբ ընդդիմության կամ պարզ քաղաքացիների կողմից որոշակի գործողություններ են կատարվում՝ քաղաքացիական ընդվզման տեսքով, կամ իրենց իրավունքներն իրացնելու առումով, միանգամից ամբողջ իրավապահ համակարգը ռեպրեսիվ ապարատով հարձակվում է և շատ արագ մեկուսացնում են այդ մարդկանց։ Երբ համանման արարք, իսկ առանձին դեպքերում ավելի ծանր արարքներ են կատարում իշխանության ներկայացուցիչները, դատախազությունը ոչ միայն լռում է, ոչ միայն քայլ չի ձեռնարկում, ավելին՝ փորձում է արդարցնել այդ մարդկանց արածները»,- հայտարարեց Մինասյանը։
Պատգամավորի խոսքով՝ քաղբանտարկյալների և քաղհալածյալների մեծ բանակը վկայությունն է այն բանի, որ մենք, ցավոք սրտի, ունենք «բռնաբարված» արդարադատություն ու իրավունքներ, այլ ոչ թե պաշտպանված։
Նա խոսեց Սահամանդրական կարգի խախտումների մասին և նշեց, որ Սահամանդրական կարգի առանցքային դրույթը ՀՀ տարածքների որևէ կերպ փոխանցումը որևէ երկրի բացառապես հանրաքվեի միջոցով իրակացնելու պարտականությունն է, և որ այս գործառույթի հանցավոր ոտնձգությունից պաշտպանելու լիազորությունը գլխավոր դատախազությունը չի իրականացնում, հակառակը՝ հղում է տալիս, ասում է՝ դե ուղարկել ենք, տեսնենք՝ ինչ կլինի, մինչդեռ Սահամանդրությամբ դատախազության լիազորությունն է քրեական հետապնդման հարուցումը։
Նա նշեց, որ առանց պատշաճ իրավական հիմքերի ականազերծում իրականացնելն անվտանգության դեմ ուղղված հանցագործություն է։
«Սա է որ գլխավոր դատաախզությունը պարտավոր է պաշտպանել, ապահովել և թույլ չտալ, որ նման գործողություն իրականացվի առանց պատշաճ հիմքերի։ Այն, ինչ կատարվում է այսօր Տավուշի մարզում, առանձնապես ծանր հանցագործություն է, որի պատասխանատվությունը դրված է օրվա իշխանության և նրանց աջակցող, նրանց ապօրինությունները սպասարկող իրավապահ համակարգի վրա»։
