Գեղակերտի 62-ամյա բնակչի սպանության համար մեղադրանք է ներկայացվել վերջինիս որդուն

2024 թվականի ապրիլի 20-ին հաղորդում է ստացվել այն մասին, որ նախօրեին՝ ժամը 21։45-ին, «Էջմիածին» ԲԿ «կտրած-ծակած վերքեր» ախտորոշմամբ բուժօգնության է տեղափոխվել Արմավիրի մարզի Գեղակերտ բնակավայրի 62-ամյա բնակիչ, ով ժամեր անց, գիտակցության չգալով, մահացել է:
Նույն օրը՝ ժամը 22։10-ին, նույն բնակավայրի բնակչից ոստիկանության Վաղարշապատի բաժնում հաղորդում է ստացվել այն մասին, որ 2024 թվականի ապրիլի 19-ին՝ ժամը 21։00-ի սահմաններում, իրենց տանը իր 38-ամյա եղբայրը, կենցաղային հարցերի շուրջ ծագած վիճաբանության ընթացքում, խոհանոցային դանակով հարվածել է հորը՝ հիվանդանոց տեղափոխված վերոհիշյալ 62-ամյա տղամարդուն՝ պատճառելով մարմնական վնասվածք:
Դեպքի առթիվ ՀՀ քննչական կոմիտեի Արմավիրի մարզային քննչական վարչության Վաղարշապատի քննչական բաժնում, ՀՀ քրեական օրենսգրքի 155-րդ 2-րդ մասի 9-րդ կետի հատկանիշներով (սպանությունը՝ կատարված մերձավոր ազգականի կողմից), նախաձեռնվել է քրեական վարույթ:
Քննությամբ պարզվել են դեպքի էական մի շարք հանգամանքներ, այդ թվում՝ շարժառիթը:
Նախնական տվյալներով՝ դեպքի օրը տուժողի և նրա որդու միջև ընտանեկան, անձնական հարցերի շուրջ ծագած տարաձայնությունները վեր են ածվել վիճաբանության, որի ժամանակ վերջինս, վերցնելով խոհանոցային դանակը, մոր ներկայությամբ, հարվածներ է հասցրել հոր կրծքավանդակի աջ հատվածին՝ պատճառելով կյանքի հետ անհամատեղելի մարմնական վնասվածքներ և դիմել փախուստի:
Նախաքննության ընթացքում կատարվել է դեպքի վայրի զննություն, որի ընթացքում հայտնաբերվել է հանցագործության գործիք խոհանոցային դանակը՝ արնանման հետքերով։ Նշանակվել են դիակի դատաբժշկական, դատակենսաբանական, դատահետքաբանական փորձաքննություններ, հարցաքննվել են մի շարք անձինք։
Իրականացված քննչական, օպերատիվ-հետախուզական և օպերատիվ-որոնողական միջոցառումների արդյունքում ենթադրյալ հանցագործություն կատարած անձը՝ տուժողի որդին, հայտնաբերվել և, հանցանք կատարած լինելու անմիջականորեն ծագած կասկածի հիմքով, ձերբակալվել է։
Ձեռք բերված բավարար փաստերի հիման վրա՝ 38-ամյա տղամարդուն մեղադրանք է ներկայացվել՝ ՀՀ քրեական օրենսգրքի 155-րդ 2-րդ մասի 9-րդ կետով: Միջնորդություն է ներկայացվել դատարան՝ նրա նկատմամբ կալանավորումը որպես խափանման միջոց կիրառելու վերաբերյալ, որը բավարարվել է:
Նախաքննությունը շարունակվում է, որի շրջանակներում կատարվում են ապացուցողական և վարութային գործողություններ:
Ոստիկանության համապատասխան ստորաբաժանմանը տրվել են հանձնարարություններ:
Ծանուցում. Հանցանքի համար մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
