«Քաղաքական իրավունքների հայկական կենտրոն» իրավապաշտպան հասարակական կազմակերպության հայտարարությունը Նարեկ Սամսոնյանին եւ Վազգեն Սաղաթելյանին բերման ենթարկելու վերաբերյալ

Մարտի 22-ին համացանցում տարածվեց բլոգեր Նարեկ Սամսոնյանի նկատմամբ բռնության գործադրմամբ ձերբակալության տեսանյութը՝ ոստիկանական համազգեստով և քաղաքացիական հագուստով մի խումբ անձանց կողմից։ Նույն օրը դիմակավորված ոստիկանները բերման ենթարկեցին բլոգգեր Վազգեն Սաղաթելյանին՝ որը Ն․ Սամսոնյանի հետ միասին ընդդիմադիր ուղղվածության «Իմնեմնիմնի» փոդքասթի համահեղինակն է։
Ն․ Սամսոնյանին ձերբակալելու ընթացքը պատկերող տեսանյութում վերջինիս նկատմամբ կիրառվում է անմարդկային և նվաստացնող վերաբերմունքի դրսևորմամբ անհամաչափ և կոպիտ ուժ՝ թեև Ն. Սամսոնյանը որևէ դիմադրություն չի ցուցաբերում։ Բռնության է ենթարկվում նաև ոստիկանության ապօրինի գործողությունները նկարահանող անձը։
Ինչպես հայտնի դարձավ հետագայում՝ Ն․ Սամսոնյանի և Վ․ Սաղաթելյանի նկատմամբ իրականացված գործողությունների պատճառը վերջիններիս համահեղինակած փոդքասթի ընթացքում հնչեցված արտահայտություններն են, որոնք իշխանությունների համար լինելով վիրավորական՝ իրավապահների կողմից որակվել են որպես խուլիգանություն (ՀՀ քրեական օրենսգրքի 297-րդ հոդված)։ Նման որակում տալով իրավապահները ամբողջությամբ խեղաթյուրել և անտեսել են հանցակազմի իրավական կողմը։
Իշխանության ներկայացուցիչների նկատմամբ ենթադրաբար վիրավորական արտահայտությունների հիմքով քրեական գործ հարուցելով իրավապահները փաստացի կիրառել են 2021-2022 թվականներին գործող «ծանր վիրավորանքի» հանցակազմը (նախկին քրեական օրենսգրքի 137․1-րդ հոդված): Նշված հանցակազմի գործողությունը դադարեցվել էր Եվրոպայի խորհրդի, Եվրոպական միության, ՌԱԵՀ, ԵԱՀԿ, Freedom House կազմակերպության և այլ դերակատարների կողմից խստորեն քննադատվելու արդյունքում՝ արտահայտման ազատության սահմանափակման չափանիշներին չհամապատասխանելու պատճառով։
ՀՀ իշխանությունների գործելաոճից բխում է, որ չնայած վերը նշված հոդվածի ապաքրեականացմանը, նույնաբովանդակ մեղադրանքները շարունակվում են ներկայացվել ընդդիմադիր հայացք ունեցող անձանց դեմ՝ քողարկված այլ մեղադրանքով, տվյալ դեպքում՝ խուլիգանության հանցակազմով։
Քաղաքական իրավունքների հայկական կենտրոնը հայտարարում է, որ մշտադիտարկելու է այս գործի ողջ ընթացքը՝ հնարավոր քաղաքական հետապնդման տարրերը վերհանելու նպատակով։
