«Փաստ» օրաթերթը գրում է.

Ֆինանսների նախարարությունը և Ազգային անվտանգության ծառայությունը համատեղ մշակմամբ հանրային քննարկման են ներկայացրել նախագիծ, որով առաջարկում են լրացումներ կատարել «Պետական գաղտնիքի մասին» օրենքում: Նշվում է, որ այս նախագծի ընդունման անհրաժեշտությունը պայմանավորված է առանց պետական գաղտնիք պարունակող տեղեկություններին առնչվելու թույլտվության օտարերկրյա իրավաբանական և ֆիզիկական անձանցից պետական գաղտնիք պարունակող գնումներ իրականացնելու հնարավորություն ընձեռող կառուցակարգեր նախատեսելու անհրաժեշտությամբ:

«Պետական գաղտնիքի մասին» օրենքի 20-րդ հոդվածի 2-րդ մասի համաձայն՝ պետական գաղտնիք պարունակող տեղեկություններին առնչվելու համար Հայաստանի Հանրապետության քաղաքացիները, օտարերկրյա քաղաքացիները և քաղաքացիություն չունեցող անձինք պետք է ունենան թույլտվություն, որը տրվում է Հայաստանի Հանրապետության քաղաքացիների, օտարերկրյա քաղաքացիների և քաղաքացիություն չունեցող անձանց գրավոր համաձայնությամբ, լիազոր մարմնի կողմից նրանց նկատմամբ ստուգողական միջոցառումներ (այդ թվում՝ օրենսդրությամբ սահմանված օպերատիվ-հետախուզական միջոցառումներ) անցկացնելու և այդ միջոցառումների դրական արդյունքների հիման վրա համապատասխան մարմինների կողմից նրանց հետ պարտավորագիր կնքելու միջոցով:

Նշված գործընթացն օտարերկրյա քաղաքացիների պարագայում, որպես կանոն, տևական ժամանակ է պահանջում, ինչն հաճախ ավելի է բարդանում՝ պայմանավորված տվյալ օտարերկրյա պետության օրենսդրության առանձնահատկություններով։ Արդյունքում օտարերկրյա իրավաբանական կամ ֆիզիկական անձից հնարավոր չի լինում իրականացնել պետության կարիքների համար գնումների կատարում, ինչը հղի է բազմաթիվ բացասական հետևանքներով։ Նշվում է, սակայն, որ տվյալ բնագավառում իրականացվող քաղաքականության փոփոխություն չի նախատեսվում:

Նախագծով առաջարկվում է ՀՀ կառավարությանը վերապահել օտարերկրյա իրավաբանական և ֆիզիկական անձանցից պետության կարիքների բավարարման նպատակով պետական գաղտնիք պարունակող գնումների կատարման դեպքերը և պայմանները սահմանելու լիազորություն: Նախագծի ընդունմամբ այլ իրավական ակտերում փոփոխություններ կամ լրացումներ կատարելու անհրաժեշտություն չի առաջանում, ինչպես նաև չի նախատեսվում ծախսերի և եկամուտների էական ավելացում կամ նվազեցում պետական կամ տեղական ինքնակառավարման մարմնի բյուջեում:
