Երեխան ինքը կընտրի ազգությունը․ նոր նախագիծ՝ պատգամավորի կողմից

ԱԺ «Հայաստան» խմբակցության պատգամավոր Իրինա Գասպարյանը նոր նախագիծ է ներկայացրել, որով առաջարկվում է «Քաղաքացիական կացության ակտերի գրանցման մասին» օերնքում փոփոխություններ և լրացումներ կատարել։
Ըստ նախագծի՝ հանվում է ծննդյան վկայականից և ակտային գրանցումից երեխայի ազգությունը նշելու պահանջը, ինչպես նաև երեխան ինքն է ընտրում իր ազգությունը՝ ծնողների՝ տարբեր ազգություն ունենալու դեպքում անձը հաստատող փաստաթուղթ կամ անձնագիր ստանալիս։
Հիմնավորման մեջ նշվում է, որ այս պահին գործող նորմերի տարաբնույթ մեկնաբանությունները խնդիրներ են առաջացնում առաջին դասարանը համալրելիս այն երեխաների համար, որոնց ծնողներից մեկը ազգությամբ հայ չէ։ Բանն այն է, որ ՀՀ-ում դպրող ընդունելիս, եթե ծննդյան վկայականում նշված է երեխայի՝ ազգությամբ հայ լինելու հանգամանքը, արդեն իսկ նա պետք է հաճախի հայերենի ուսուցմամբ դասարան։ Նշված դեպքերում ծնողները դիմում են երեխայի ազգությունը փոխելուն, որպեսզի օգտվեն երեխայի ուսուցման լեզուն ընտրելու իրենց իրավունքից։
Հետևաբար երեխայի ծննդի բոլոր ակտերում ազգությունը նշելը դառնում է ոչ միայն անիմաստ, այլև խախտում է երեխայի իրավունքը, հակասաում ՀՀ միջազգային իրավունքին՝ ըստ որի՝ «Երեխայի ազգությունը որոշվում է ծնողների ազգությանը համապատասխան։ Եթե երեխայի ծնողների ազգությունը տարբեր է, ապա այն որոշվում է երեխայի ցանկությամբ իր հոր կամ մոր ազգությանը համապատասխան՝ նրան անձնագիր կամ անձը հաստատող փաստաթուղթ տրամադրելիս»։
Նախագծում ընդգծվում է, որ արդյունքում տարբեր ազգության ծնողներից կազմված ընտանիքները հնարավորություն կունենան իրացնելու երեխաների ուսուցման լեզվի իրենց իրավունքը և նրանց ուսուցումը կազմակերպելու իրենց նախընտրած լեզվով։
