Civil Voice հասարակական կազմակերպության կողմից ուսումնասիրվել է «Դինո Գոլդ Մայնինգ Քամփնի» ՓԲԸ-ի եւ դրա իրավահաջորդ հանդիսացող «Դանդի Փրիշս Մեթալս Կապան» ընկերության «ՀՀ Սյունիքի մարզի Կապանի պղնձի եւ Շահումյանի ոսկի-բազմամետաղային հանքավայրերի շրջապատող տարածքի» հանքերեւակումներում երկրաբանական ուսումնասիրության իրավունք տվող փաստաթղթերը, ինչի արդյունքում բացահայտվել են հետաքրքիր փաստեր: Հասարակական կազմակերպության հասարակայնության եւ կապերի բաժնի կողմից մեզ տրամադրած տեղեկատվության համաձայն՝ լիցենզիայում եւ պայմանագրերում ամրագրված է, որ ուսումնասիրության ժամկետը լրանում է 2010թ. ապրիլի 15-ին, սակայն 2010թ. հունիսի 16-ին՝ հանքային իրավունքի ավարտից երկու ամիս անց, ՀՀ էներգետիկայի եւ բնական պաշարների արդեն նախկին նախարար Արմեն Մովսիսյանի հրամանով ընկերության թիվ 25 եւ թիվ 233 փաստաթղթերում կատարվել են փոփոխություններ՝ եւս 2 տարով երկարաձգելով հանքային իրավունքը:

«Ընդերքի մասին» ՀՀ օրենսգրքի 80-րդ հոդվածի 5-րդ մասի համաձայն՝ նախկինում տրված լիցենզիաները մինչեւ դրանց վերաձեւակերպումը պահպանում են իրենց ուժը եւ կարող են վերաձեւակերպվել՝ պահպանելով նախկինում տրված լիցենզիաների գործողության ժամկետները: Սակայն ՀՀ էներգետիկայի եւ բնական պաշարների նախարարությունը, խախտելով ՀՀ «Ընդերքի մասին» օրենսգրքի վերը նշված նորմը, 2012 թ. հուլիսի 13-ին վերաձեւակերպելով 2012 թ. ապրիլի 15-ի դրությամբ արդեն իսկ դադարած հանքային իրավունքը, ըստ Civil Voice ՀԿ-ի, «վերակենդանացրել է» արդեն մոտ 3 ամիս գոյություն չունեցող ընդերքօգտագործման իրավունքը՝ միաժամանակ թույլտվության գործողության ժամկետ սահմանելով հետին ամսաթիվ՝ 2012թ. ապրիլի 15-ը:

Դրան հաջորդել է արդեն նախկին նախարարի մյուս ապօրինությունը՝ նախարարի 2012 թ. օգոստոսի 23-ի հրամանով հանձնարարվել է 2 տարով երկարաձգել ուսումնասիրության «վերակենդանացված» թույլտվությունը՝ կատարելով փոփոխություններ 2012թ. ապրիլի 15-ին արդեն իսկ գործողությունը դադարած պայմանագրի ժամկետ սահմանելով 2014թ. ապրիլի 15-ը: Եվ արդեն ներկայիս նախարար Երվանդ Զախարյանը 2014թ. սեպտեմբերի 23-ի հրամանով համապատասխան փոփոխություններ է կատարել ընդերքօգտագործման թույլտվությունում եւ պայմանագրում դրանց ժամկետների լրանալուց մոտ 5 ամիս հետո՝ վերջնաժամկետ սահմանելով 2016թ. ապրիլի 15-ը:

Ըստ ՀԿ-ի տրամադրած տեղեկատվության՝ թույլտվության գործողության ժամկետները երկարաձգվել են արդեն երրորդ անգամ, ինչը նույնպես ՀՀ «Ընդերքի մասին» օրենսգրքի կոպիտ խախտում է, քանի որ ժամկետները կարող են երկարաձգվել առավելագույնը 2 անգամ:

Վերը նշված փաստերն ապացուցում են, որ ՀՀ էներգետիկայի եւ բնական պաշարների նախարարության կողմից «Դինո Գոլդ Մայնինգ Քամփնի» ՓԲԸ-ին տրամադրված ընդերքօգտագործման իրավունքի ժամկետների բոլոր երկարացումները եւ հանքային իրավունքի վերաձեւակերպումները կատարվել են օրենքի եւ սահմանված ժամկետների կոպիտ խախտումներով: Civil Voice հասարակական կազմակերպությունը դիմել է հակակոռուպցիոն մարմիններին՝ վերը նշված փաստերը քննության առնելու պահանջով:
