«Փաստ» օրաթերթը գրում է.

Արդարադատության նախարարությունն առաջարկում է լրացումներ կատարել Քաղաքացիական դատավարության օրենսգրքում: Դրա 123-րդ հոդվածի 2-րդ մասի համաձայն՝ առաջին ատյանի դատարանն իրավունք ունի մինչև ապացուցման պարտականությունը բաշխելու մասին որոշում կայացնելը մեկ վարույթում միացնել իր վարույթում քննվող մի քանի միատեսակ գործեր, որոնցով գործին մասնակցող անձինք լրիվ կամ մասնակի համընկնում են, եթե դրանց միջև առկա է փոխադարձ կապ, ու դրանց համատեղ քննությունը կարող է ապահովել գործերի առավել արագ և արդյունավետ լուծումը: Այսինքն՝ օրենսդիրը նախատեսել է հնարավորություն միացնել մի քանի միատեսակ գործեր՝ պայմանով, որ դրանք պետք է լինեն մեկ դատավորի վարույթում: Հետևաբար՝ միմյանց հետ փոխկապակցված, սակայն տարբեր դատավորների վարույթներում գտնվող գործերը միացնելու օրենսդրական հնարավորությունը բացակայում է:

«Ապօրինի ծագում ունեցող գույքի բռնագանձման մասին» օրենքի կարգավորումների համաձայն՝ եթե միմյանց հետ փոխկապակցված անձանց (այդ թվում՝ միևնույն ընտանիքի անդամների) վերաբերյալ առկա են ապօրինի ծագում ունեցող գույքի բռնագանձման մեկից ավելի վարույթներ, դրանցից յուրաքանչյուրով Հակակոռուպցիոն դատարան են ներկայացվում առանձին հայցադիմումներ: Հայցադիմումները մակագրման ավտոմատացված համակարգի միջոցով մակագրվում են դատավորներին՝ առանց հաշվի առնելու դրանց միջև առկա փոխադարձ կապը: Քաղաքացիական դատավարության օրենսգրքի գործող կարգավորումների պայմաններում Հակակոռուպցիոն դատարանի մեկից ավելի դատավորներ պետք է իրարից անկախ հետազոտեն միևնույն կամ իրար հետ փոխկապակցված փաստերը, դրանք հիմնավորող ապացույցները և դրանց կապակցությամբ տան իրավական գնահատականներ:

Ըստ նախարարության, սա խնդրահարույց է ինչպես դատավարության շրջանակներում ռեսուրսների օգտագործման արդյունավետության, այնպես էլ Հակակոռուպցիոն դատարանի տարբեր դատավորների կողմից միևնույն փաստերի կապակցությամբ տարբեր (որոշ դեպքերում նաև իրարամերժ) գնահատականներ տալու անթույլատրելիության տեսանկյունից: Նախագծի համաձայն՝ Հակակոռուպցիոն դատարանը ապօրինի ծագում ունեցող գույքի բռնագանձման գործերով մինչև ապացուցման պարտականությունը բաշխելու մասին որոշում կայացնելը կարող է թույլատրել մեկ վարույթում միացնելու տարբեր վարույթներում քննվող մի քանի գործեր, եթե նման միջնորդություն ներկայացնող կողմը հիմնավորում է, որ դրանց միջև առկա է փոխադարձ կապ և դրանց համատեղ քննությունը կարող է ապահովել գործերի առավել արագ և արդյունավետ լուծումը: Գործերը միացվում են հայցադիմումը ներկայացնելու պահին առավել մեծ հայցագին ունեցող վարույթում:
