«ՄՏՍ Հայաստանի» կասկածելի գործարքը. ազգային անվտանգությանը կամ պետական շահերին սպառնացող վտանգը «վերադարձա՞վ». «Փաստ»

«Փաստ» օրաթերթը գրում է.

Ինչպես հայտնի է, հանրային ծառայությունները կարգավորող հանձնաժողովը հավանություն է տվել «ՄՏՍ Հայաստանի» 100 % բաժնեմասի վաճառքին։ Գնորդը «Ֆեդիլքո Գրուպ Լիմիթիդ» ընկերությունն է: Արտաքուստ սովորական թվացող «առքուվաճառքի» այս գործարքը, սակայն, ուշագրավ է նրանով, որ ընդամենը մի քանի ամիս առաջ ՆՈՒՅՆ հանձնաժողովը մերժել էր ՆՈՒՅՆ «ՄՏՍ Հայաստանի» բաժնետոմսերը ՆՈՒՅՆ կազմակերպությանը վաճառելու փաստացի ՆՈՒՅՆ հայտը: Ընդ որում, ԲՏԱ նախարարության բացասական եզրակացության հիման վրա կայացրած որոշման մեջ հատուկ հղում էր կատարվել օրենքի դրույթին, համաձայն որի, «գործարքի համաձայնեցումը կարող է մերժվել, եթե, իրավասու մարմնի գնահատմամբ, վնասում կամ կարող է վնասել ազգային անվտանգությունը կամ պետական շահերը»:

Սակայն այդպես էլ որևէ պարզաբանում չհնչեց, թե ինչպես է այս մի քանի ամսում վերացել «ազգային անվտանգությունը կամ պետական շահերը վնասելու» վտանգը: Մի խոսքով, բավական տարօրինակ գործարք է: Սա՝ մեղմ ասած: Ավելին, նշյալ գործարքի հետ կապված մի շարք առնվազն մութ ու կասկածելի հանգամանքները պարզելու նպատակով հանցագործության մասին հաղորդում է ներկայացվել ՀՀ գլխավոր դատախազին և Հակակոռուպցիոն կոմիտեի նախագահին: Սակայն, ինչպես տեղեկացրել էր փաստաբան Արմինե Ֆանյանը, «ՄՏՍ Հայաստան» ՓԲԸ-ն անհայտ ընկերությանը հանձնելու վերաբերյալ իր հաղորդման կապակցությամբ ՀՀ հակակոռուպցիոն կոմիտեն որոշել է վարույթ չնախաձեռնել: Նա նաև նշել էր, որ այս որոշումը բողոքարկելու է: «Փաստի» հետ զրույցում փաստաբանը նշեց. «Բողոքարկվել է գլխավոր դատախազություն:

Օրինականության նկատմամբ հսկողություն իրականացնող դատախազի կողմից որոշում ենք ստացել մեր բողոքը մերժելու մասին: Այժմ այդ որոշումը բողոքարկվել է Հակակոռուպցիոն դատարան, դեռևս վարույթ հարուցելու մասին որոշում չենք ստացել»: Նյութը պատրաստ էր տպագրության, երբ հայտնի դարձավ, որ Հանրային ծառայությունները կարգավորող հանձնաժողովի՝ հունվարի 17-ին կայանալիք նիստի օրակարգում է «ՄՏՍ Հայաստանը» վաճառելու գործարքը մերժելու հարցը։ Ընդ որում, որպես հիմնավորում նշվում է այն հանգամանքը, որ ընկերության վաճառքի հետ կապված առարկություն է ներկայացրել բարձր տեխնոլոգիական արդյունաբերության նախարարությունը։ Ուշագրավ է, որ հանկարծ նորից ի հայտ է եկել «ազգային անվտանգությունը կամ պետական շահերը վնասելու» հանգամանքը: Այս ամբողջ մութ պատմության մեջ փաստացի միակ դրականն այն է, որ լրատվամիջոցների, այդ թվում՝ մեր՝ ոչ մեկ անգամ բարձրացրած խնդիրը, կարծես, ուշադրության է արժանացել և ընթացք ստացել:
