Չինարիի հայտնի գործով ՄԻԵԴ-ն ընդդեմ Ադրբեջանի վճիռ է կայացրել

Չինարիի հայտնի գործով Եվրոպական դատարանի վճիռը ընդդեմ Ադրբեջանի - երեք զինծառայողների սպանություն ադրբեջանցի զինծառայողի կողմից (ում գործն ընդդեմ Հայաստանի ի դեպ մերժվեց վերջերս) առանց կոնկրետ ռազմական անհրաժեշտության - մարդու իրավունքների և միջազգայան մարդասիրական իրավունքի զուգամիտում, որի պայմաններում ՄԻԵԴ-ն այս անգամ առավելությունը տվեց մարդու իրավունքներին։ Այս մասին հայտնում է միջազգային իրավունքի փորձագետ Արա Ղազարյանը։
«Սա շատ կարևոր վճիռ է այն իմաստով, որ ՄԻԵԴ-ը հաղթահարեց ինքն իրեն ու կայացրեց որոշում մարտական հերթապահության ժամանակ հակառակորդի կողմից անհարկի ռազմական ուժ կիրառելու մասին։ Ի դեպ, այս գործով կարևոր էր, որ հնարավոր եղավ ապացուցել, որ Ադրբեջանի կառավարությունը ներկայացրել է պատմության կեղծ վարկած, որը ՄԻԵԴ-ն ըստ էության հաստատեց, ասելով, որ Ադրբեջանի պնդումը, թե իբրև թե հայկական ուժերն էին հարձակվել Ադրբեջանի դիրքերի վրա ոչ միայն ծայրահեղ սպեկուլյատիվ էր, այլ նաև անհնարին։
