«Փաստ» օրաթերթը գրում է.
Արդարադատության նախարարությունն առաջարկում է փոփոխություններ և լրացումներ կատարել «Փաստաբանության մասին» օրենքում և Քրեական դատավարության օրենսգրքում: Նախագծով, որը մշակվել է նախարարության և Փաստաբանների պալատի կողմից, նախատեսվում է կանոնակարգել դատարաններում կամ պետական այլ մարմիններում փաստաբանական գործունեություն իրականացնելիս փաստաբանի հանդերձանքին և արտաքին տեսքին ներկայացվող պահանջները: Դրանք պետք է սահմանվեն Փաստաբանների պալատի խորհրդի կողմից: Այս պահանջները փաստաբանների կողմից պահպանելու պարտականությունը սահմանվել է որպես փաստաբանի վարքագծի կանոն:
Նախագծի մի շարք կարգավորումներով նախատեսվում է բարելավել անվճար իրավաբանական օգնության գործող կառուցակարգերը, հստակեցնել մատուցվող ծառայությունների շահառուներին և ծավալները, առավել արդյունավետ դարձնել անվճար իրավաբանական օգնություն տրամադրելու համար իրականացվող վարչարարությունը: Միևնույն ժամանակ առաջարկվում է բարելավել ակնհայտ վճարունակ մեղադրյալին կամ տուժողին ցույց տրված իրավաբանական օգնության վճարման համար պետության կատարած ծախսերը բռնագանձելու մեխանիզմները: Նախագծով առաջարկներ են ներկայացվել նաև հանրային պաշտպանի գրասենյակի մասով, մասնավորաբար՝ նախատեսվում է բարելավել և հստակեցնել հանրային պաշտպանի գրասենյակին պետբյուջեից տրամադրվող գումարի ձևավորման մեխանիզմը՝ հաշվի առնելով հանրային պաշտպանի մեկ հաստիքի ծանրաբեռնվածության միավորը:
Օրենքով կկարգավորվեն նաև կարգապահական վարույթի կասեցման և վերսկսման հարցերը։ Այսպիսով՝ նախագծի կարգավորումների արդյունքում առավել արդյունավետ կդառնա անվճար իրավաբանական օգնության համար պետության կողմից հատկացվող միջոցների կառավարումը և օգտագործումը, փոփոխությունները միտված են նաև նվազեցնելու հանրային պաշտպանների գերծանրաբեռնվածությունը: Ակնկալվում է հստակեցնել կարգապահական վարույթի իրականացման կարգը, նախատեսել վարույթի կասեցման հնարավորությունը, ինչպես նաև ապահովել փաստաբանների պատշաճ կեցվածքը և արտաքին տեսքը դատարաններում և պետական այլ մարմիններում:
