Սնանկության ամբողջ վարույթը կիրականացվի էլեկտրոնային եղանակով

Օրենսդրական նախաձեռնության ընդունման անհրաժեշտությունը պայմանավորված է 2019 թվականի դեկտեմբերին ընդունված եւ 2020 թվականի ապրիլին ուժի մեջ մտած «Սնանկության մասին» օրենքում իրականացված մեծածավալ փոփոխություններով, իրավակիրառ պրակտիկայում ի հայտ եկած բազմաթիվ խնդիրներով եւ էլեկտրոնային արդարադատության գործիքների ներդրման հրամայականով եւ բխում է դատաիրավական ոլորտի 2022-2026 թվականների բարեփոխումների ռազմավարությունից:
Այս մասին ասել է ՀՀ արդարադատության նախարարի տեղակալ Արա Մկրտչյանը՝ ԱԺ պետական-իրավական հարցերի մշտական հանձնաժողովի՝ նոյեմբերի 23-ի հերթական նիստում առաջին ընթերցմամբ քննարկման ներկայացնելով «Սնանկության մասին» օրենքում փոփոխություններ եւ լրացումներ կատարելու մասին» օրենքի նախագիծը:
Ըստ փոխնախարարի՝ ակնկալվում է ապահովել սնանկության վարույթը՝ սկսած դրա հարուցումից մինչեւ ավարտը, էլեկտրոնային եղանակով իրականացնելու հնարավորություն, ինչպես նաեւ լուծել իրավակիրառ պրակտիկայում ծագած որոշ հրատապ խնդիրներ, մասնավորապես, անդրադառնալով կամավոր սնանկության չարաշահման դեպքերին ու պարտապանի կողմից ներկայացվող փաստաթղթերի ցանկին, սնանկության կառավարիչների ինստիտուտի որոշ հարցերի, պարտատերերի ժողովների անցկացման եղանակներին, պարտատերերի պահանջների հնարավորինս բավարարման եւ պարտապանի վճարունակության վերականգնման, ֆինանսական առողջացման եւ աճուրդների վերաբերյալ կարգավորումներին:
