Շուրջ հինգ ամիս ապօրինի կալանքի տակ է պահվում Արցախի պաշտպանության բանակի գնդապետ Նորայր Ասլանյանը

«Հրազենի և ռազմամթերքի ենթադրյալ ապօրինի շրջանառության գործով մեղադրվող գնդապետ Ասլանյանին կալանավորելու որոշումը կայացրել է Երևան քաղաքի ընդհանուր իրավասության դատարանը՝ դատավոր Կարեն Ֆարխոյանի նախագահությամբ։ Միևնույն նախագահողի կողմից կայացվել է կալանքը երկարացնելու որոշումը, և մերժվել կալանավորումը այլ խափանման միջոցով փոխարինելու մասին պաշտպանական կողմի միջնորդությունը։

«Ուշագրավ է, թե ինչ անհիմն մեղադրանքով և անպատշաճ պատճառաբանությամբ է ֆորմալիզացվում զինվորական մարդուն ազատությունից զրկելը։ Արցախի Հանրապետության նախագահի աշխատակազմում անվտանգության վարչության պետի տեղակալի պաշտոնը զբաղեցրած գնդապետ Ասլանյանը մեղադրվում է այն զենքն ու ռազմամթերքը պահելու համար, որն օրինական կարգով տրամադրվել է իրեն» - նշել է փաստաբան Արմեն Անդրիկյանը։

Ըստ պաշտպանի՝ ուշագրավ է նաև այն հանգամանքը, որ Նորայր Ասլանյանի նկատմամբ իրականացվող քրեական հետապնդումը հանձնարարվել է ՀՀ ԱԱԾ քննչական գլխավոր վարչությանը, սակայն պարզ չէ, թե ինչ տրամաբանությամբ է նման տեսակի ենթադրյալ հանցագործության դեպքը ՀՀ քննչական կոմիտեում քննվելու փոխարեն քննվում ՀՀ ԱԱԾ քննչական գլխավոր վարչությունում։ Սա ևս մեկ անգամ փաստում է այն հանգամանքը, որ Նորայր Ասլանյանի նկատմամբ իրականացվողը դուրս է զուտ իրավական համատեքստից և ունի թաքնված այլ նպատակներ։

Մինչդատական վարույթի տվյալների գաղտնիությամբ պայմանավորված՝ պաշտպանական թիմի կողմից այս պահին ավել մանրամասներ չեն կարող ներկայացվել, սակայն նրանց համոզմամբ  գործի հիմքում իրավական առումով աբսուրդային մեղադրանք է։ Փաստաբաններն այդ մեղադրանքն ուղղակիորեն հերքող ապացույցները ներակայացրել են դատարան և վարույթն իրականացնող մարմնին, սակայն անհայտ պատճառներով այդ ապացույցներին ո՛չ դատարանը, ո՛չ էլ վարույթն իրականացնող մարմինը որևէ անդրադարձ չեն կատարել։

Նախկինում Նորայր Ասլանյանին կալանավորելու մասին որոշումներում իրավապահ համակարգը ներկայացնում էր երկու փաստարկ. առաջինը, որ զինվորականը կարող է խոչընդոտել քննությանը, քանի որ վայելում է հեղինակություն հանրության շրջանում, և երկրորդ՝ որ կարող է թաքնվել քննությունից՝ հեռանալով Արցախ։ Հինգ ամիս  քննությունը իրականացնելուց և Արցախի ամբողջական հայաթափումից հետո, ըստ փաստաբանների, առնվազն տարակուսելի է, թե որքանով են քննությանը խոչընդոտելու և Արցախ մեկնելու պատճառաբանություններն արդիական։

Հիշեցնենք, որ Նորայր Նելսոնի Ասլանյանը բարձրագույն ռազմական կրթությամբ զինվորական հրամանատար է, ով Հայոց բանակում ծառայել է 1991-ից մինչև 2022 թվականները։ Ռազմական գործում գրանցած զգալի հաջողությունների համար պարգևատրվել է Մարտական խաչ երկրորդ և առաջին աստիճանի, ինչպես նաև ՀՀ և ԱՀ Մարտական ծառայության բազմաթիվ շքանշաններով։ 2021 թվականից Արցախի Հանրապետության նախագահի աշխատակազմում զբաղեցրել է անվտանգության վարչության պետի տեղակալի պաշտոնը»,- նշված է հայտարարության մեջ։
