Ինչ պետք է իմանալ անկանխիկ գործարքների մասին. ՊԵԿ

ՀՀ տարածքում 2023 թվականի հուլիսի 1-ից ֆիզիկական անձանց միջև 300 000 դրամը գերազանցող բոլոր գործարքներն իրականացվում են անկանխիկ։ Օրենքը խախտելու դեպքում առաջանում է տուգանք՝ 100 000 դրամի չափով, եթե դա առաջին խախտումն է։ Մեկ տարվա ընթացքում երկրորդ անգամ խախտումով գործարք իրականացնելիս՝ կառաջադրվի տուգանք՝ 200 000 դրամի չափով:
Ո՞ր դեպքում են հարկ վճարողները գործարքներն իրականացնում անկանխիկ. Հարկ վճարողները՝ անհատ ձեռնարկատերերը կամ կազմակերպությունները ֆիզիկական անձանց հետ 300 000 դրամը գերազանցող գործարքները պետք է իրականացնեն անկանխիկ։ Բացառություն է, երբ գործարքն իրականացվում է օտարերկրյա քաղաքացու և քաղաքացիություն չունեցող անձի հետ և մանրածախ առևտրում՝ Tax free-ով։ Ո՞ր դեպքում հարկ վճարողները պետք է վճարումները պարտադիր իրականացնեն անկանխիկ. Անկախ գումարի չափից՝ նոտարական, փաստաբանական ծառայությունների, ինչպես նաև հաշվապահական, աուդիտորական, իրավաբանական, ֆինանսական, ՏՏ և այլ խորհրդատվական ծառայությունների մատուցման դեպքում՝ վճարումները պարտադիր իրականացվում են անկանխիկ։
Օրենքը խախտելու դեպքում առաջանում է տուգանք՝ կանխիկ վճարման թույլատրված չափը գերազանցող գումարների հանրագումարի 5%-ի չափով, բայց ոչ պակաս, քան 500 000 դրամը և ոչ ավելի, քան 2 մլն դրամը։ Արձանագրմանը հաջորդող մեկ տարվա ընթացքում կրկին խախտելու դեպքում՝ խախտման գումարների հանրագումարի 10%-ի չափով, բայց ոչ պակաս, քան 1 մլն դրամը և ոչ ավելի, քան 4 մլն դրամը։ Անկանխիկ վճարումներ՝ բժշկական և կրթության ոլորտներում. Երևանում և մարզերի վարչական կենտրոններում բժշկական կազմակերպություններում մատուցված բոլոր բժշկական և ուսումնական (այդ թվում՝ բարձրագույն) հաստատություններում մատուցված բոլոր ծառայությունների դիմաց վճարումներն ընդունվում են անկանխիկ, իսկ այլ բնակավայրերում կընդունվեն 2024 թվականի հուլիսի 1-ից։ Նույն ժամանակագրությամբ են անկանխիկ իրականացվում կրթաթոշակների, ներկայացուցչական ծախuերի, գործուղման, պետական գնումների հետ կապված վճարումները:
