«Փաստ» օրաթերթը գրում է.

Արդարադատության նախարարությունն առաջարկում է փոփոխություններ և լրացումներ կատարել կառավարության 2020 թ. հունիսի 9-ի N 847-Ն որոշման մեջ: ՀՀ քրեական դատավարության օրենսգրքի 212-րդ հոդվածի 1-ին մասը նախատեսում է անչափահասի, անգործունակի, ինչպես նաև հոգեկան առողջության խնդիր ունեցող անձի մասնակցությամբ քննչական գործողության կատարմանը որակավորված հոգեբանի ներգրավման պահանջ: N 847-Ն որոշումը վերաբերում է հոգեբանների որակավորման կարգին, որոշման կիրառման արդյունքում ի հայտ են եկել մի շարք խնդիրներ: Մասնավորաբար, չկան հոգեբանի որակավորման վկայականի գործողության ժամկետի, դրա գործողության դադարեցման, հոգեբանի մասնագիտական աշխատանքային ստաժի պահանջի վերաբերյալ կարգավորումներ, առկա են անհարկի բարդեցված ընթացակարգեր և անհստակություններ: Անհրաժեշտ է համարվում շտկել գործընթացն այն արդյունավետ ու պարզ իրականացնելու, որակյալ կադրեր ներգրավելու համար: Քննչական կոմիտեի տվյալների վերլուծությունը ցույց է տվել, որ 2024 թ.-ին մոտավոր հաշվարկով կարիք կլինի նվազագույնը 25 որակավորված հոգեբանի:

Ներկայում որակավորված հոգեբանները 33-ն են, արտահերթ որակավորման ստուգմանը մասնակցելու համար ներկայացված դիմումների քանակը 11-ն է, ստուգումը նախատեսված է իրականացնել 2023 թ. նոյեմբերի 22-ին: Բացի դա, 25 հոգեբանի որակավորման վկայականը դադարելու է գործել 2024 թ. հունվարի 1-ից, ուստի կանխատեսվում է, որ 2024 թվականի համար ներկայիս պայմաններում հնարավոր չի լինի ապահովել որակավորված հոգեբանների նշված քանակը, և, ըստ այդմ, որպես միջանկյալ լուծում, անհրաժեշտ է երկարաձգել արդեն իսկ փորձառություն ունեցող 25 հոգեբանի որակավորման վկայականների գործողության ժամկետը, որպեսզի ապահովվի քննչական գործողությունների պատշաճ իրականացումը: Նախագծի ընդունումից հետո հնարավոր կլինի նոր կարգով ձեռնամուխ լինել հոգեբանների ներգրավմանը, ըստ անհրաժեշտության կվերանայվեն նաև որակավորման դասընթացների վերաբերյալ կարգավորումները:

Այսպիսով՝ առաջարկվում է հստակ սահմանել, որ որակավորման վկայականը տրամադրվում է անժամկետ՝ միևնույն ժամանակ նախատեսելով դրա գործողության կասեցման ու դադարեցման դեպքեր, խթանել առավել մասնագիտացված կադրերի ներգրավումը, օրինակ՝ դիմորդի համար նախատեսվել է մագիստրոսի կամ դիպլոմավորված մասնագետի որակավորման, մասնագիտական առնվազն մեկ տարվա ստաժ ունենալու պահանջ և այլն: Նախագծի ընդունմամբ ակնկալվում է ունենալ անչափահասի, անգործունակի կամ հոգեկան առողջության խնդիր ունեցող անձի մասնակցությամբ քննչական գործողության կատարմանը ներգրավվող հոգեբանների որակավորման առավել մշակված, համակարգային, արդյունավետ ու հստակ կարգավորումներ։
