Վարչական ակտը բողոքարկելու համար քաղաքացին նախ պետք է դիմի հնարավոր հարթակներ, վերջում՝ դատարան. նախագիծ. «Փաստ»

«Փաստ» օրաթերթը գրում է.

Ներքին գործերի նախարարությունն առաջարկում է փոփոխություններ և լրացում կատարել «Վարչական իրավախախտումների վերաբերյալ» օրենսգրքում: Օրինակ՝ առաջարկում է սահմանել ոստիկանության մարմինների կողմից կայացված վարչական ակտերի և դրսևորած գործողությունների և անգործության վերադասության կարգով բողոքարկման/գանգատարկման պահանջ (արտադատական ընթացակարգ), նախքան դատական կարգով դիմելը:

Նախարարությունն ուսումնասիրել է միջազգային փորձը, ընդգծում է՝ ընդունված է այն մոտեցումը, որ դատական ծանրաբեռնվածությունը թեթևացնել իրականում հնարավոր է, եթե վարչական ակտի վերանայման համար դատարան դիմելուց առաջ սահմանվի բողոքարկման այլ հարթակներին դիմելու պարտադիր պայման։ Հայաստանում պարտադիր այլընտրանքային վարչական արդարադատություն իրականացնող մարմին գոյություն չունի, սակայն գործող նորմատիվ իրավական ակտերի շրջանակներում որոշակի փոփոխությունների և համակարգում բարեփոխումների իրականացման միջոցով կարելի է դատական ծանրաբեռնվածությունը որոշակի չափով նվազեցնել: Ոստիկանության իրավասու մարմինների կողմից կայացված վարչական ակտերը, դրսևորած գործողությունների կամ անգործության վերանայումը ներկայումս իրականացվում է նաև վերադաս մարմնի կողմից։

Սակայն վարչական ակտի հասցեատերը որոշ դեպքերում իրավունք ունի համապատասխան վարչական ակտը միանգամից բողոքարկել դատական կարգով՝ առանց վարչական կարգով գանգատ ներկայացնելու։ Ներկայումս այդ իրավակարգավորումները հանգեցնում են վարչական դատարանների անհարկի ծանրաբեռնմանը։ Օրենսգրքում փոփոխություններ կատարելու հիմնական նպատակը հետևյալն է՝ քաղաքացին նախ պետք է դիմի բողոքարկման հնարավոր հարթակներ, վերջում՝ դատարան:

Մեկ այլ փոփոխությամբ առաջարկվում է վերանայել ոստիկանության իրավասու մարմինների կողմից կայացված վարչական իրավախախտումների վերաբերյալ ակտերի դեմ դատական կարգով գանգատարկման համար սահմանված պետական տուրքի չափը, ավելի կոնկրետ՝ բարձրացնել այն: Նախատեսվում են այլ փոփոխություններ ևս:
